Regulation 2004

Partnership Act 1892

Council, has made the following Regulation under the Partnership Act 1892.

Explanatory note
The objects of this Regulation are as follows:

(a)	to increase, in line with movements in the Consumer Price Index, certain fees payable under the Partnership Act 1892, and
(b)	to provide for the fees payable under the Act in respect of incorporated limited partnerships, and
(c)	to make other changes as a consequence of the commencement of the Partnership Amendment (Venture Capital Funds) Act 2004.

This Regulation is made under the Partnership Act 1892, including sections 73E (5) and

81 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Partnership Amendment Regulation 2004.

2 Commencement

This Regulation commences on 5 April 2004.

3 Amendment of Partnership Regulation 2002

The Partnership Regulation 2002 is amended as set out in
Schedule 1.

Omit “section 54 (2) (h) of the Act”.
Insert instead “section 54 (2) (n) of the Act”.

Omit clause 7. Insert instead:

7 Fees

(1)

The fees payable under the Act are as set out in Schedule 2.

(2)

The amount of a fee of a type specified in column 2 of
Schedule 2 is:

(a)	in relation to a limited partnership—the amount specified opposite the type of fee concerned in column 3 of Schedule 2, and
(b)	in relation to an incorporated limited partnership—the amount specified opposite the type of fee concerned in column 4 of Schedule 2.
