PARRAMATTA STADIUM TRUST ACT 1988 - BY-LAW

(Relating to the management of trust land)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Parramatta Stadium Trust Act 1988, has been pleased to approve the By-law made by the Parramatta Stadium Trust and set forth hereunder.

Citation

1. This By-law may be cited as the Parramatta Stadium Trust By-law

1989.

Definitions

2. In this By-law:

"authorised officer" means a person appointed in writing by the

Trust to be an authorised officer for the purposes of this By-law;

"Ground" means the trust land;
"stadium" means the stadium constructed on the Ground;

"the Act" means the Parramatta Stadium Trust Act 1988;

"Trust'' means the Parramatta Stadium Trust.

Entry to stadium

3. (1) A person shall not at any time, without the approval of the Trust or an authorised officer, enter the stadium unless the person:

(a) is in lawful possession of; and

(b)

produces for inspection on demand made by an authorised officer or a trustee,

a ticket of admission purchased by or on behalf of the person and
authorising entry to the stadium.

(2) The Trust may set apart at any time any portion of any grandstand in the stadium for reserved seats in respect of which an extra charge may be made.

4. On demand made by an authorised officer or a trustee, any person within the stadium (not being a person to whom approval has been given under clause 3 (1)) shall forthwith produce for inspection a ticket of admission entitling the person to be within the stadium.

Unauthorised possession of ticket of admission

5. A person who has possession of any ticket of admission to the stadium to which the person is not entitled shall, on demand made by an authorised officer or a trustee, surrender up the ticket to the authorised officer or trustee.

Admission of vehicles

6. The Trust may authorise the admission to the Ground of a vehicle of any description and its driver or controller:

(a)

on such terms and conditions as the Trust may from time to time determine; and

(b)

on payment of such charge for admission (if any) as the Trust may from time to time determine.

Directions relating to booths, bars etc.

7. A person renting or having any booth, bar, stall or stand at the Ground shall comply with any direction of the Trust, or an authorised officer, with respect to the booth, bar, stall or stand.

Intoxicating liquor

8. (1) A person shall not (without the approval of the Trust or an authorised officer) bring liquor onto the Ground unless the person holds rights to sell liquor in the bars or other places set apart for the purpose.

(2) A person shall not, within the Ground, sell or supply liquor to any person under the age of 18 years.

(3) In this clause:

"liquor" has the same meaning as in the Liquor Act 1982.

Behaviour within the Ground

9. (1) A person shall not, without the authority of the Trust or an authorised officer, within the Ground:

(a) enter any area or building not open to the public; or

(b)

make an address or conduct or hold a meeting, match or musical performance or any amusement; or

(c) sell, offer for sale or distribute any article or other thing; or

(d)

have or operate television, cinematographic, photographic, broadcasting or recording equipment for commercial purposes; or

(e) camp or permanently reside; or

(f)

except in the course of, and as a normal incident of, a sporting event or training for a sporting event, deliberately damage any lawn, playing field or green; or

(g)

damage, pick or remove any tree, shrub, plant, vine, flower or other vegetation; or

(h)

remove or disturb any rock, soil, sand, stone or similar substance; or

(i) light any fire; or

(j)

affix any bill or poster on any tree or on any building, fence, seat, table, enclosure or other structure; or

(k) distribute any bill or poster; or

(l)

climb in any tree or on any building, or climb or jump over any fence, seat, table, enclosure or other structure; or

(m)

allow any animal in the person’s custody or under the person’s control to enter or remain in the stadium unless the animal is to be or is being exhibited in a show or display held with the permission of the Trust; or

(n) erect any house, booth, bar, shed, stall or other structure; or

(o)

contravene any condition to which the person’s entrance was subject.

(2) A person shall not, within the Ground:

(a)

leave any rubbish or litter, except in receptacles provided for the purpose; or

(b)

break, damage, deface, obliterate or cover any structure, machinery, equipment, sign, descriptive plate or label; or

(c)

obstruct any employee of or contractor to the Trust in the performance of the employee’s or contractor’s work; or

(d)

throw or project any stone or other missile except at a side show or ring display authorised by the Trust or in the course of, and as a normal incident of, a sporting event or training for a sporting event; or

(e)

do or say anything calculated to hinder or interfere with the proper progress of any football or other match, game, sport or event; or

(f)

park, drive, ride or act contrary to any sign erected by the Trust that regulates the parking, traffic flow or movement of vehicles or animals.

Entry onto playing fields

10. A person shall not enter or remain upon a playing field within the Ground unless the person is:

(a)

a participant in any football match, game, sport or event held with the permission of the Trust; or

(b)

a person engaged in the control or management of any football match, game, sport or event held with the permission of the Trust; or

(c)

a person who has, or a member of a class of persons that has, been given permission by the Trust to go on the playing field.

Removal from Ground

11. (1) A person who contravenes this By-law or who otherwise causes annoyance or inconvenience to members of the public within the Ground or any part of the Ground may be removed from the Ground or that part by a member of the Police Force or by an authorised officer.

(2) A member of the Police Force or an authorised officer acting in accordance with this clause may exert such force as may be reasonable and lawful in the circumstances for the purpose of exercising the member’s or officer’s powers under this clause.

Obstruction of authorised persons

12. A person shall not hinder or obstruct a member of the Police Force, an authorised officer or a trustee in the exercise of any power conferred on the member, officer or trustee by this By-law.

Penalty

13. A person who contravenes this By-law is guilty of an offence and is liable to a penalty not exceeding 5 penalty units.

Less ees and licensees

14. Notwithstanding any other provision of this By-law, an act or omission does not constitute a contravention of this By-law if it is authorised expressly or impliedly by the terms or conditions of any lease or licence granted by the Trust.

EXPLANATORY NOTE

The object of this By-law is to make provision (similar to that contained in the Cumberland Oval By-law 1987) for the control and regulation by the Parramatta Stadium Trust of the Parramatta Stadium and trust lands.
