1      Name of Plan

This Plan is Parramatta City Centre Local Environmental Plan 2007

(Amendment No 3).

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Land to which Plan applies

This Plan applies to all land to which Parramatta City Centre Local

Environmental Plan 2007 applies.

4      Maps

Each map adopted by Parramatta City Centre Local Environmental Plan 2007 that is specified in Column 1 of the following Table is declared by this Plan to be amended or replaced, as the case requires, by the map specified opposite in Column 2 of the Table as approved by the Minister on the making of this Plan.

Local Environmental Plan 2007

[1]      Clause 22A Minimum building street frontage

Omit “(1)” from clause 22A (3). Insert instead “(2)”.

[2]      Clause 29A Outdoor advertising and signage

Omit clause 29A (2) (c).

[3]      Schedule 2 Exempt development

Insert after the Schedule heading:

Note 1. State Environmental Planning Policy (Exempt and Complying Development Codes) 2008 specifies exempt development under that Policy. The Policy has State-wide application. This Schedule contains additional exempt development not specified in that Policy.

Note 2. Exempt development may be carried out without the need for development consent under the Act. Such development is not exempt from any approval, licence, permit or authority that is required under any other Act and adjoining owners’ property rights and the common law still apply.

Insert in alphabetical order:

Markets

(1)

Must be carried out on land owned or managed by the Council.

(2)

Any building or other structure installed for the markets:

(a)	must not exceed a total floor area of 20% of the site area or 350 square metres, whichever is the lesser, and
(b)	must be structurally adequate, and
(c)	must not exceed a height of 4 metres, and
(d)	must be at least 3 metres from any property boundary, and
(e)	must not be used for residential purposes or the storage or display of flammable or hazardous materials, and
(f)	must be set up and dismantled on any day that the market is held during the hours specified in subclause (3).

Must operate only between 7am and 5pm.
