Act No. 89, 1982.

An Act to repeal section 2a of the Parole of Prisoners Act, 1966, so that the powers, authorities, duties and functions of the Parole Board under that Act may be exercised in respect of persons subject to control within the meaning of the Community Welfare Act, 1982, and to make other amendments consequent upon the enactment of the Community Welfare Act, 1982. Parole of Prisoners {Community Welfare) Amendment.

BE it enacted by the Queen’s Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows:—

Short title.

1.           This Act may be cited as the “Parole of Prisoners (Community

Welfare) Amendment Act, 1982”.

Commencement.

2.     (1) This section and section 1 shall commence on the date of assent

to this Act.

(2) Except as provided by subsection (1), this Act shall commence on the day appointed and notified under section 2 (2) of the Community Welfare Act, 1982.

Amendment of the Act No. 41, 1966.

3. The Parole of Prisoners Act, 1966, is amended in the manner set

forth in Schedule 1.

(1) Section 2 (2) (e)—

Omit the paragraph.

(2) Section 2a—

Omit the section.

(3) (a) Section 8 (2) (b )—

Omit “as amended by subsequent Acts, the Director of the Child Welfare Department”, insert instead “or was formerly a person subject to control within the meaning of the Community Welfare Act, 1982, the Director, as defined in section 4 (1) of the Community Welfare Act, 1982,”.

(b) Section 8 (2) (b )—

After “institution” where secondly occurring, insert “or while a person subject to control”.
