An Act to amend section 3 of the Parliamentary Remuneration Tribunal Act, 1975, with respect to the period during which remuneration is payable to members of the Legislative Council. [Assented to, 18th April, 1979.]

Parliamentary Remuneration Tribunal {Constitution) Amendment.

BE it enacted by the Queen’s Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows :—

Short title.

1 .

This Act may be cited as the “Parliamentary Remuneration

Tribunal (Constitution) Amendment Act, 1979”.

Amendment

2. The Parliamentary Remuneration Tribunal Act, 1975, is

inserting in section 3 ( 1 a ) (b) (iii) after the words “general election” the words “of members of the Legislative Assembly”;

(b)

by inserting after section 3 (1a) the following subsection :—

( 1 b ) For the purposes of this Act, a person elected as a member of the Legislative Council shall be deemed—

(a)

to become a member of the Legislative Council on the day of his election; and

(b)

to cease to be a member of the Legislative Council on—

(i) the day of his death;

(ii)   the day on which his seat as such a member becomes vacant, otherwise than pursuant to section 2 2 b ( 1 ) (c) of the Constitution Act, 1902; or

Parliamentary Remuneration Tribunal (Constitution) Amendment.

(iii)   the day appointed for the taking of the poll for the periodic Council election within the meaning of that Act that next follows the day on which he

ceases, pursuant to section 2 2 b ( 1 )

(c) of that Act, to be a member of the

Legislative Council,

whichever first occurs.
