2 Parliamentary (Judges) Commission of Inquiry Act Amendment Act 1989, No. 1 BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled , and by the authority of the same, as follows:- 1. Short Title . This Act may be cited as the Parliamentary (Judges) Commission of Inquiry Act Amendment Act 1989. 2. Citation . (1) In this Act the Parliamentary (Judges) Commissionof Inquiry Act 1988 is referred to as the Principal Act. (2) The Principal Act as amended by this Act may be cited as the Parliamentary (Judges) Commission of Inquiry Act 1988-1989. 3. New s. 10A. The Principal Act is amended by inserting after section 10 the following section:- "10A. Access to further relevant material . (1) Notwithstanding the provisions of any other Act, information concerning matters coming to the knowledge of a member or the secretary of the Police Complaints Tribunal constituted by the Police ComplaintsTribunal Act 1982-1987 in the course of his duties as such member or, as the case may be, secretary may be disclosed by any such person to any person- (a) certified by the presiding member to be a legal representative of His Honour Judge Eric Charles Ernest Pratt for the purposes of the inquiry referred to in section 4 (1) (b); or (b) certified by the presiding member to be a barrister or solicitor appointed or engaged by the Commission, provided that any person to whom any such information is disclosed shall not use or disclose such information except for the purposes of the inquiry referred to in section 4 (1) (b). (2) The Commission may, in its discretion, make available to a person certified under subsection 1 (a) any book, document, writing, record, property or thing of whatever description obtained by the Commission from the said Police Complaints Tribunal, or any copy or summary thereof or extract therefrom, provided that any person to whom any such thing is made available shall not use or disclose such thing except for the purposes of the inquiry referred to in section 4 (1) (b). (3) Any person who takes any action pursuant to and in accordance with this section shall not by virtue thereof be taken- (a) to have breached any oath taken or affirmation made; (b) to have, committed an offence against the provision of any Act; or (c) to have rendered himself liable to disciplinary action.".
