Act No. 58, 1986
An Act to amend the Parliamentary Electorates and Elections Act 1912 with respect to the duties of, and the matters to be taken into consideration by, the Electoral Districts Commissioners when carrying out a distribution of electoral districts. [Assented to, 20 May 1986]

BE it enacted by the Queen’s Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows:
Short title
| 1, This Act may be cited as the | ‘Parliamentary Electorates and Elections |
(Amendment) Act 1986” .
Amendment of Act No. 41, 1912
2. The Parliamentary Electorates and Elections Act 1912 is amended by
omitting section 17a and by inserting instead the following section:
Criteria for distributions
1 7a. [n carrying out a distribution, the commissioners shall, subject
to complying with section 28 of the Constitution Act 1902—
| (a) | have regard to demographic trends within the State and, as far as practicable, endeavour to ensure on the basis of those trends that, 4 years from the day of the return of the writs for choosing the Legislative Assembly that exists at the time the distribution is carried out, the number of electors enrolled in each electoral district will be equal; and |
| (b) | subject to paragraph (a), give due consideration, in relation to each electoral district, to— |
(i) community of interests within the electoral district, including economic, social and regional interests;
(ii) means of communication and travel within the electoral district;

(iii) the physical features and area of the electoral district; and
(iv) the boundaries of the existing electoral districts.
