Parliamentary Committees Regulations 1992

1. Title

These Regulations may be cited as the

Parliamentary Committees Regulations 1992.

2. Objective

The objective of these Regulations is to specify the travelling allowance and the expense allowance payable to members of parliamentary committees.

3. Authorising provisions

These Regulations are made under section 51A
and section 54 of the Parliamentary Committees

Act 1968.

4. Revocation

(1) The Parliamentary Committees (Allowances)

Regulations 19811 are revoked.

(2) The Parliamentary Committees (Allowances)

(Amendment) Regulations 19812 are revoked.

5. Definitions

In these Regulations—

"capital city" means Canberra, Sydney,

Brisbane, Darwin, Perth, Adelaide and

Hobart;

"home base" means the principal place of

residence of a member;

"Melbourne" means the area lying within a

radius of 28 kilometres from the Melbourne

Post Office;

"Rate A" means the daily rate of allowances in

respect of personal expenses for "Capital
cities including Canberra" as prescribed from
time to time in Part 4 of the Public Service
Determinations under the Public Service
Act 1974;

"Rate B" means the daily rate of allowances in respect of personal expenses of "All other places within Australia" as prescribed from

time to time in Part 4 of the Public Service
Determinations under the Public Service

Act 1974;

"Rate C" is 64% of Rate A.

6. Expense allowance

The expense allowance payable to every member of a committee (including the chairman) in attendance at a meeting of a committee outside his or her electorate or away from his or her home base is one-third of Rate A.

7. Travelling allowance

The travelling allowance payable to every member of a committee (including the chairman) for direct travel to or from a meeting of a committee is—

(a)

at Rate A for an overnight stay in a capital city;

(b)

at Rate B for an overnight stay anywhere else in Australia other than—

(i) in the member's electorate; or
(ii) in Melbourne;

(c) at Rate C in Melbourne if the member's home base is outside of Melbourne;
(d) at one-third of the appropriate rate to which the member is entitled under paragraph (a), (b) or (c)—

(i)  when absent from the member's home base for not less than six hours but not occasioning an overnight stay; or

(ii)  where the absence from the member's home base does not involve a second or subsequent overnight stay, but the absence exceeds by six hours a period of twenty-four hours.

8.  Travelling allowance under regulation 7(d) is additional

The payment of a travelling allowance under regulation 7(d) is in addition to any allowance payable under regulation 7(a), (b) or (c).

9.  When member receives a residential allowance under Parliamentary Allowances Regulations 1992

A member of a committee (including the chairman) when attending a meeting of a committee in Melbourne is not entitled to receive

an expense allowance or a travelling allowance if
the member receives a residential allowance under
regulation 6 of the Parliamentary Allowances
Regulations 1992.

10.  Expense allowance not payable to member who has received travelling allowance

A member of a committee (including the chairman) who has been paid a travelling allowance is not entitled to receive an expense

allowance in addition to the travelling allowance.

11.  Entitlement to allowances when Parliament is sitting

12.  Allowance not payable where member receives other allowance

A member is not entitled to receive any sum under these Regulations where the member receives any other sum by way of travelling or expense

NOTES

1.  General Information

The Parliamentary Committees Regulations 1992, S.R. No. 181/1992 were made on 30 June 1992 by the Governor in Council under sections 51A and 54 of the Parliamentary Committees Act 1968, No. 7727/1968 and came into operation on 30 June 1992.

The Parliamentary Committees Regulations 1992 will sunset on
1 February 2003 (see section 5 of the Subordinate Legislation Act 1994).
