Parliamentary Commission of Inquiry Regulations

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Parliamentary Commission of Inquiry Act 1986.

Citation

1. These Regulations may be cited as the Parliamentary Commission of Inquiry Regulations.

Interpretation

2. In these Regulations, “the Act” means the Parliamentary Commission of Inquiry Act 1986.

Form of summons to appear before Commission

3. A summons to a person to appear before the Commission at a hearing shall be in, or to the effect of, the form set out in the Schedule.

Service of summons to appear before Commission

4. For the purposes of sub-section 24 (1) or (2) of the Act, each of the following manners of serving a summons is prescribed:

(a) where the person named in the summons is an individual—handing the summons to the person or, if on tender of the summons to the person the person refuses to accept it, putting it down in his or her presence after he or she has been told of the nature of the summons; or

(b) where the person named in the summons is a corporation—handing the summons to a person who is apparently an officer of, or in the service of, the corporation and apparently of or above the age of 16 years—

(i) at the registered office of the corporation; or

(ii) if there is no registered office, at the principal place of business or the principal office of the corporation,

or, if on tender of the summons to such a person the person refuses to accept it, putting it down in his or her presence after he or she has been told of the nature of the summons.

SUMMONS TO APPEAR BEFORE THE COMMISSION

I, , a member of the Parliamentary Commission of Inquiry appointed under the Parliamentary Commission of Inquiry Act 1986 hereby summon you, pursuant to sub-section 11 (1) of that Act—

(a) to appear before the Commission at the hearing to be held at (address where Commission is to sit)   on (date)  at (time) to give evidence in relation to the matters into which the Commission is inquiring *[and to produce this summons and the   documents/  things/  documents and other things / described in the Schedule]; and

(b) to attend from day to day unless excused or released from further attendance.
