PARLIAMENTARY ALLOWANCES AND SALARIES
ACT.
Act No. 22, 1956.
An Act to make provision with regard to the allowances and salaries of Members of the Legislative Council and Legislative Assembly,, Ministers of the Crown and certain other persons; to amend the Constitution Act,
1902, the Parliamentary Allowances and
Salaries Act, 1951, and certain other Acts; and for purposes connected therewith. [Assented to, 12th October, 1956.]

lative Council and Legislative Assembly of New South BE it enacted by the. Queen's Most Excellent Majesty, by and with the advice and consent of the Legis Wales in Parliament assembled, and by the authority of the same, as follows:—
1. (1) This Act may be cited as the "Parl iamentary Allowances and Salaries Act, 1956".
(2) The Constitution Act, 1902, as amended by sub sequent Acts, is in this Act referred to as the Principal Act.
(3) This Act shall be deemed to have commenced on the third day of March, one thousand nine hundred and fifty-six.
2 . (1) The Principal Act is amended by omitting from section 17G the words "five hundred pounds" where secondly occurring and by inserting in lieu thereof the words "s ix hundred pounds".
(2) There shall be payable to—
(a) the President of the Legislative Council a salary at the rate of two thousand three hundred pounds per annum; and (b) the Chairman of Committees of the Legislative Council a salary at the rate of one thousand five hundred pounds per annum.
(3) Every Member of the Legislative Council now serving or hereafter to serve therein whose permanent residence is in an electoral district specified in Par t I I , I I I or IV of the Fifth Schedule to the Principal Act shall, unless he is one of the persons specified or referred to in
section 17n of the Principal Act or receives the additional allowance provided in section 17o of the Principal Act for the principal representative of those Members of the Legislative Council who are not supporters of the Government, be entitled to receive a living away from home allowance at the rate of three pounds three shillings for each day he attends a sitting of the Legislative Council. 3. The Principal Act is further amended— (a) (i) by omitting from section twenty-eight the
words " the next following section" and by inserting in lieu thereof the words "section
twenty-nine of this A c t " ; (ii)
(ii) by omitting from the same section the words " o n e thousand eight hundred and seventy- five pounds pe r a n n u m " and by inser t ing in lieu thereof the words " o n e thousand nine hundred and seventy-five pounds per annum and an electoral allowance at the year ly ra te specified in the F i f th Schedule to this Act in respect of the electoral
dis tr ict for which he is the M e m b e r ' ' ; (iii) by omitting from the same section the words " T h e Leader of the Opposit ion shall be entit led to receive an addi t ional allowance of five hundred pounds per annum. And the Government W h i p and the Opposit ion W h i p shall each be entit led to receive an addi t ional allowance a t the ra te of three
hundred and fifty pounds per a n n u m . " : (iv) by omitting from the same section the words
" S u c h a l lowance" and by inser t ing in lieu
thereof the words " S u c h a l lowances" ; (v) by omitting from the same section the words
" f r o m the t ime of his taking his s e a t " and
by inser t ing in lieu thereof the words " f r o m
the day of his e l ec t ion" ; (vi)
by omitting from the same section the words " P r o v i d e d tha t in the case of every Member elected after the first day of May, one thousand nine hundred and seven, such allowance shall be reckoned from the day of his e lec t ion ." ;
b) by inserting next after section twenty-eight the following new section:— 28A. The Governor may by proclamat ion published in the Gazette amend or v a r y the F i f th Schedule to this Act in such manner as he may deem necessary to give effect to any dis t r ibut ion of electoral dis t r ic ts carr ied out under and in accordance with the P a r l i a m e n t a r y Elec tora tes and Elections Act, 1912-1952.

4 . There shall be payable to each Minister of the Crown, being a member of the Executive Council, referred to in this section, the salary, the electoral allowance, if any, and the expense allowance specified in this section in relation to that Minister, namely—
(a) to the Premier a salary at the rate of four thousand four hundred and seventy-five pounds per annum and an electoral allowance at the
yearly
yearly rate specified in the Fifth Schedule to the Principal Act, in respect of the electoral dis trict for which he is the Member, and an expense allowance at the rate of one thousand pounds per annum;
(b) to the Deputy Premier a salary at the rate of three thousand seven hundred and twenty-five pounds per annum and an electoral allowance at the yearly rate specified in the Fifth Schedule to the Principal Act, in respect of the electoral district for which he is the Member, and an expense allowance at the rate of five hundred pounds per annum; (c) to the Vice-President of the Executive Council and to each of thirteen other Ministers of the Crown a salary at the rate of three thousand two hundred and twenty-five pounds per annum and an expense allowance at the rate of five hundred pounds per annum and where any such Minister of the Crown is a Member of the Legislative Assembly an electoral allowance at the yearly rate specified in the Fifth Schedule to the Principal Act in respect of the electoral district for which he is the Member. 5 . ( 1 ) There shall be payable to—
(a) the Speaker of the Legislative Assembly a salary at the rate of nine hundred pounds per annum and an expense allowance at the rate of
two hundred and fifty pounds per annum;(b)
the Chairman of Committees of the Legislative Assembly a salary at the rate of four hundred pounds per annum and an expense allowance at the rate of one hundred pounds per annum;
(c)
the Leader of the Opposition in the Legislative Assembly a salary at the rate of one thousand pounds per annum and an expense allowance at the rate of two hundred and fifty pounds per annum;
(d)
(d)
the Deputy Leader of the Opposition in the Legislative Assembly a salary at the rate of four hundred pounds per annum;
(e)
the Leader in the Legislative Assembly (other than the Leader of the Opposition or the Deputy Leader of the Opposition) of a recognised political party not less than ten members of which are members of the Legislative Assembly and of which no member is the holder of any office of profit specified in the Second Schedule to the Principal Act a salary at the rate of four hundred pounds per annum; and
(f)
the Government and Opposition Whips in the Legislative Assembly a salary at the rate of three hundred and fifty pounds per annum and an expense allowance at the rate of one hundred pounds per annum.
(2) The salaries and allowances provided for in subsection one of this section shall be in addition to the allowances provided for by section twenty-eight of the Principal Act.
6 . (1 ) All moneys payable by way of allowance or salary under subsections two and three of section two and under section four and subsection one of section five of this Act shall bo chargeable to the Consolidated Revenue Fund and shall be payable monthly at the rates aforesaid.
| (2) Any monthly payment to which a Member of the Legislative Council or a Member of the Legislative Assembly is entitled under subsection two or three of section two or under section four or subsection one of section five of this Act or any part of such monthly payment not drawn by him or on his behalf within twenty- eight days after such monthly payment becomes due and payable to him shall revert to the Treasury and shall form part of the Consolidated Revenue Fund. |
7 . The Parliamentary Allowances and Salaries Act,
1951, is amended by omitting sections three, four, five
and six.
