s1 4 s4 Parliament of Queensland Amendment Act 2004 No. 7, 2004 The Parliament of Queensland enacts— 1 Short title This Act may be cited as the Parliament of Queensland Amendment Act 2004 . 2 Act amended This Act amends the Parliament of Queensland Act 2001. 3 Amendment of s 70 (Meaning of “transacts business”) (1) Section 70(2)(a)(ii)— omit, insert— ‘(ii) the contract, to the extent of the member’s interest, provides for— (A) the provision by an entity of the State of goods or services, that are available to the public, on the same terms the goods or services are available to the public; or (B) the acquisition from an entity of the State of an interest in land, that is available to the public, on the same terms the interest is available to the public; or (C) the acquisition by an entity of the State of an interest in land on terms not less favourable to the entity than if the sale were by a member of the public; or’. (2) Section 70(2)(a), examples of subparagraph (ii)— omit. 4 Insertion of new s 163 After section 162— insert—

s4 5 s4 Parliament of Queensland Amendment Act 2004 No. 7, 2004 ‘163 Transitional provision for the Parliament of Queensland Amendment Act 2004 ‘ (1) During the transitional period, section 71(2) 1 is taken always to have applied in relation to a contract as if the amendment had commenced on 6 June 2002. ‘ (2) For deciding whether a member has contravened section 71(1) during the transitional period, section 72(1)(h) 2 is taken to apply as if the amendment had commenced on 6 June 2002. ‘ (3) Section 159(6) 3 has effect as if the amendment had commenced on 6 June 2002. ‘ (4) In this section— “amendment” means the Parliament of Queensland Amendment Act 2004 , section 3. 4 “transitional period” means the period starting at the beginning of 6 June 2002 and ending at the end of the day before the commencement of the amendment.’. © State of Queensland 2004 1 Section 71 (Restrictions on member transacting business with an entity of the State) 2 Section 72 (Vacating seats of members in particular circumstances) 3 Section 159 (Transitional provisions relating to chapter 4) 4 Parliament of Queensland Amendment Act 2004 , section 3 (Amendment of s 70 (Meaning of “transacts business”))
