The Parliament of Victoria enacts:
PART 1—PRELIMINARY
1Purposes
The purposes of this Act are—
(a)to amend the Carlton (Recreation Ground) Land Act 1966 to alter land at Princes Park that is subject to that Act; and
(b)to amend the Crown Land (Reserves) Act 1978—
(i)to provide for the creation of the Wandong Regional Park; and
(ii)to make amendments in relation to the Bendigo Regional Park; and
(iii)to make other miscellaneous amendments; and
(c)to amend the Forests Act 1958 in relation to protected public land; and
(d)to amend the Great Ocean Road and Environs Protection Act 2020 to improve the operation of that Act; and
(e)to amend the Heritage Rivers Act 1992 to add land to the Wimmera Heritage River Area; and
(f)to amend the Mineral Resources (Sustainable Development) Act 1990 to specify the Wandong Regional Park as restricted Crown land; and
(g)to amend the National Parks Act 1975—
(i)to create the Mount Buangor National Park, the Pyrenees National Park and the Wombat-Lerderderg National Park; and
(ii)to create the Cobaw Conservation Park, the Hepburn Conservation Park and the Mirboo North Conservation Park; and
(iii)to extend the Yellingbo Landscape Conservation Area, to change its name to the Liwik Barring Landscape Conservation Area and to provide for licences in relation to that area; and
(iv)to make provision for deer hunting by stalking in certain parts of the Pyrenees, Wombat-Lerderderg, Snowy River and Errinundra national parks; and
(v)to amend the boundaries and descriptions of certain parks; and
(vi)to make other miscellaneous amendments; and
(h)to amend the St. Kilda Land Act 1965 to alter the land that is subject to that Act; and
(i)to revoke the proclamation of the native game sanctuaries at Mount Cole, Langi Kal Kal and Mount Mistake; and
(j)to repeal the National Parks (Amendment) Act 1989.
2Commencement
(1)Part 1, Part 2, Division 2 of Part 3, Part 4, Part 5, Part 7, Divisions 5 to 12 of Part 8, Part 9, Part 10, Part 11, Part 12, sections 7, 9 and 10 and Schedule 1 come into operation on the day after the day on which this Act receives the Royal Assent.
(2)Subject to subsection (3), the remaining provisions of this Act come into operation on a day or days to be proclaimed.
(3)If a provision of this Act does not come into operation before 5 October 2026, it comes into operation on that day.
PART 2—AMENDMENT OF CARLTON (RECREATION GROUND) LAND ACT 1966
3Definitions
In section 2 of the Carlton (Recreation Ground) Land Act 1966, in the definition of leasable land, after paragraph (a) insert—
"(ab)the land shown hatched on the plan lodged in the Central Plan Office and numbered LEGL./23-315, being Crown Allotments 2143, 2144, 2145, 2146, 2147 and 2148, Parish of Jika Jika at Carlton; and".
PART 3—AMENDMENT OF CROWN LAND (RESERVES) ACT 1978
Division 1—Amendments in relation to Bendigo Regional Park and creation of Wandong Regional Park
4Definitions
In section 3 of the Crown Land (Reserves) Act 1978, for the definition of firewood collection area substitute—
"firewood collection area—
(a)means land determined by the Secretary in accordance with section 21P(1)(a) or (b) to be a firewood collection area; and
(b)until 1 July 2029, includes land determined by the Secretary in accordance with section 21P(1)(c) to be a firewood collection area;".
5Secretary may determine firewood collection areas
(1)In section 21P(1) of the Crown Land (Reserves) Act 1978—
(a)in paragraph (b), for "Schedule." substitute "Schedule; or";
(b)after paragraph (b) insert—
"(c)part of the land delineated and coloured pink or coloured yellow on the plan lodged in the Central Plan Office and numbered LEGL./24–214.".
(2)After section 21P(8) of the Crown Land (Reserves) Act 1978 insert—
"(9)Despite subsection (1)(c), on and after 1 July 2029—
(a)the Secretary must not make a determination under subsection (1)(c); and
(b)land determined by the Secretary to be a firewood collection area under subsection (1)(c) ceases to be a firewood collection area.".
6Dam licences—Bendigo Regional Park
For section 29I(1) of the Crown Land (Reserves) Act 1978 substitute—
"(1)The Minister may grant a licence to any person to use land for a dam on any part of the land described in Division 1 of Part 4A of the Fifth Schedule, if that land was used for a dam immediately before the commencement of—
(a)section 26(4) of the National Parks and Crown Land (Reserves) Acts (Amendment) Act 2006; or
(b)section 8 of the Parks and Public Land Legislation Amendment (Central West and Other Matters) Act 2025.".
7New Division 6 of Part 6 inserted
After Division 5A of Part 6 of the Crown Land (Reserves) Act 1978 insert—
"Division 6—Transitional and miscellaneous provisions—Parks and Public Land Legislation Amendment (Central West and Other Matters) Act 2025
64Bendigo Regional Park
(1)On the commencement of section 8 of the Parks and Public Land Legislation Amendment (Central West and Other Matters) Act 2025—
(a)any reservation under this or any other Act over any area of the land delineated and coloured pink or coloured yellow on the plan lodged in the Central Plan Office and numbered LEGL./24–214 that is in force immediately before that commencement is revoked; and
(b)the appointment of any committee of management of any area of the land delineated and coloured pink on the plan lodged in the Central Plan Office and numbered LEGL./24–214 is revoked to the extent that it relates to that land immediately before that commencement; and
(c)subject to subsection (4), the area of the land delineated and coloured pink or coloured yellow on the plan lodged in the Central Plan Office and numbered LEGL./24–214 is freed and discharged from all trusts, limitations, reservations, restrictions, encumbrances, estates and interests in or applying to any area of the land immediately before that commencement.
(2)On the commencement of section 8 of the Parks and Public Land Legislation Amendment (Central West and Other Matters) Act 2025—
(a)the area of the land delineated and coloured yellow on the plan lodged in the Central Plan Office and numbered LEGL./24–214 ceases to be a road or part of a road or a road reserve for the land; and
(b)all rights, easements and privileges existing or claimed either by the public or any body or person, as incident to the express or implied grant or past dedication or supposed dedication or any past user or operation of law or otherwise, in relation to the land to which paragraph (a) applies cease.
(3)On the commencement of section 8 of the Parks and Public Land Legislation Amendment (Central West and Other Matters) Act 2025, the area of the land delineated and coloured brown on the plan lodged in the Central Plan Office and numbered LEGL./24–214 ceases to be reserved forest within the meaning of section 3(1) of the Forests Act 1958.
(4)Despite anything to the contrary in this Act, any licence, permit or other authority over any part of the area of the land delineated and coloured pink or coloured yellow on the plan lodged in the Central Plan Office and numbered LEGL./24–214 that was granted or issued under this Act, the Forests Act 1958 or the Land Act 1958 and that is in force immediately before the commencement of section 8 of the Parks and Public Land Legislation Amendment (Central West and Other Matters) Act 2025 continues in force on and after that commencement subject to—
(a)its terms and conditions; and
(b)the provisions of this Act, the Forests Act 1958 or the Land Act 1958 (as the case requires).
65Wandong Regional Park
(1)On the commencement of section 10 of the Parks and Public Land Legislation Amendment (Central West and Other Matters) Act 2025—
(a)any reservation under this or any other Act over any area of the Wandong Regional Park that is in force immediately before that commencement is revoked; and
(b)the appointment of any committee of management of any area of the Wandong Regional Park is revoked to the extent that it relates to that land immediately before that commencement; and
(c)subject to subsection (4), the Wandong Regional Park is freed and discharged from all trusts, limitations, reservations, restrictions, encumbrances, estates and interests in or applying to any area of the land immediately before that commencement.
(2)On the commencement of section 10 of the Parks and Public Land Legislation Amendment (Central West and Other Matters) Act 2025—
(a)the land delineated and coloured yellow on the plan lodged in the Central Plan Office and numbered LEGL./24–047 ceases to be a road or part of a road or a road reserve for the land; and
(b)all rights, easements and privileges existing or claimed either by the public or any body or person, as incident to the express or implied grant or past dedication or supposed dedication or any past user or operation of law or otherwise, in relation to the land to which paragraph (a) applies cease.
(3)On the commencement of section 10 of the Parks and Public Land Legislation Amendment (Central West and Other Matters) Act 2025, the land delineated and coloured brown on the plan lodged in the Central Plan Office and numbered LEGL./24–047 ceases to be reserved forest within the meaning of section 3(1) of the Forests Act 1958.
(4)Despite anything to the contrary in this Act, any licence, permit or other authority over any part of the Wandong Regional Park that was granted or issued under the Forests Act 1958 or the Land Act 1958 and that is in force immediately before the commencement of section 10 of the Parks and Public Land Legislation Amendment (Central West and Other Matters) Act 2025 continues in force on and after that commencement subject to—
(a)its terms and conditions; and
(b)the provisions of the Forests Act 1958 or the Land Act 1958 (as the case requires).
(5)In this section—
Wandong Regional Park means the land described in Division 8 of Part 4A of the Fifth Schedule.".
8Bendigo Regional Park
In Division 1 of Part 4A of the Fifth Schedule to the Crown Land (Reserves) Act 1978—
(a)after "coloured yellow" insert "or coloured blue";
(b)after "LEGL./06–067D" insert ", and the land delineated and coloured pink or coloured yellow on the plan lodged in the Central Plan Office and numbered LEGL./24–214 to the extent that that land is at or above a depth of 100 metres below the land surface".
9Section 48 repealed
Section 48 of the Crown Land (Reserves) Act 1978 is repealed.
10New Division 8 of Part 4A of Fifth Schedule inserted
After Division 7 of Part 4A of the Fifth Schedule to the Crown Land (Reserves) Act 1978 insert—
"Division 8—Wandong Regional Park
The land delineated and coloured pink or coloured yellow on the plan lodged in the Central Plan Office and numbered LEGL./24–047.".
Division 2—Amendments relating to gendered language
11Power to reserve Crown land for public purposes
In section 4(1) of the Crown Land (Reserves) Act 1978, for "his" substitute "the Governor in Council's".
12Minister may purchase and acquire land
(1)In section 5(1) of the Crown Land (Reserves) Act 1978, for "he" substitute "the Minister".
(2)In section 5(4) of the Crown Land (Reserves) Act 1978—
(a)in paragraph (a), for "he is satisfied" substitute "the Minister is satisfied";
(b)in paragraph (b), for "he considers" substitute "the Minister considers".
13Vesting of land on appointment of new trustees

(a)is absent without the permission of the committee from 4 consecutive meetings of the committee; or
(b)becomes bankrupt or the member's property becomes in any manner subject to control under the law relating to bankruptcy; or

17Borrowing powers of incorporated committees
In section 14C(4)(e) of the Crown Land (Reserves) Act 1978—
(a)for "its or his rights" substitute "the institution's, person's or body's rights";
(b)for "for it or him" substitute "for the institution, person or body".
18Powers of committees of management
In section 15(2) of the Crown Land (Reserves) Act 1978, for "chairman" (where twice occurring) substitute "chairperson".
19Licences for purposes other than those for which land is reserved
In section 17B(3) of the Crown Land (Reserves) Act 1978—
(a)in paragraph (a), for "he or she states" substitute "the Minister states";
(b)in paragraph (b), for "he or she is satisfied" substitute "the Minister is satisfied".
20Leases for up to 65 years for other purposes

PART 4—AMENDMENT OF FORESTS ACT 1958
27Declaration of protected public lands
In section 62(1A)(d) of the Forests Act 1958—
(a)before subparagraph (i) insert—
"(iaa)Parks Victoria by an Order made under section 18(1) of the Crown Land (Reserves) Act 1978; or";
(b)in subparagraph (i), for "1975; or" substitute "1975—";
(c)subparagraphs (ii) and (iii) are repealed.
PART 5—AMENDMENT OF GREAT OCEAN ROAD AND ENVIRONS PROTECTION ACT 2020
28Definitions
In section 3 of the Great Ocean Road and Environs Protection Act 2020—
(a)in the definition of Great Ocean Road scenic landscapes area omit "of land or water";
(b)insert the following definition—
"corporate planning document means any of the following—
(a)a statement of corporate intent;
(b)a corporate plan;
(c)a business plan;".
29Great Ocean Road scenic landscapes area
(1)In section 10(1) of the Great Ocean Road and Environs Protection Act 2020 omit "of land or water".
(2)For section 10(3)(a), (b), (ba) and (c) of the Great Ocean Road and Environs Protection Act 2020 substitute—
"(a)land and water between the outer limit of Victorian coastal waters and the Great Ocean Road;
(b)land and water between—
(i)the inland boundary of the land on which the Great Ocean Road is situated; and
(ii)the inland boundary of the viewshed from any point on the Great Ocean Road, the Great Ocean Walk or the coastline;
Example
A gully is located in the area between the boundaries described paragraph (b)(i) and (ii), but cannot be seen from any point on the Great Ocean Road, the Great Ocean Walk or the coastline because it is behind a hill. The Governor in Council may make a declaration under this section relating to the area in which the gully is located, provided the other requirements of this section are met.
(c)land on which the Great Ocean Road is situated;
(d)any land and water adjacent to land and water referred to in paragraph (b);
(e)if a settlement is partially within the land and water described in paragraph (b), land and water on which the whole of that settlement is located that is not within the land and water described in paragraph (b).".
(3)For section 10(4) of the Great Ocean Road and Environs Protection Act 2020 substitute—
"(4)An Order under subsection (1) must identify the area to which it applies by reference to a numbered plan lodged in the Central Plan Office.".
30Public submissions on draft Great Ocean Road strategic framework plan
For section 25(3) of the Great Ocean Road and Environs Protection Act 2020 substitute—
"(3)The Minister must consider all submissions made to the Minister within the time period specified under subsection (1)(c).
(4)The Minister may refer any submissions that the Minister does not adopt to a panel appointed under section 26.".
31Appointment of panel
In section 26 of the Great Ocean Road and Environs Protection Act 2020, for "The Minister must" substitute "If the Minister decides to refer submissions to a panel under section 25(4), the Minister must".
32Minister to prepare revised draft Great Ocean Road strategic framework plan
(1)In section 36(a) of the Great Ocean Road and Environs Protection Act 2020, for "under section 33(4)" substitute "under section 34(2),
if a panel was appointed".(2)In section 36(b)(ii) of the Great Ocean Road and Environs Protection Act 2020, after "a panel" insert ", if a panel was appointed".
33Minister to publish notice of approval in Government Gazette
For section 38(1)(b) of the Great Ocean Road and Environs Protection Act 2020 substitute—
"(b)any Minister who administers an Act under which public land is managed, if—
(i)that public land is within the Great Ocean Road region; and

34Establishment of the Authority

35Functions of the Authority

"(e)to manage visitation in the Great Ocean Road coast and parks;".
36Performance of functions and exercise of powers—general
(1)In section 48B(1)(b) of the Great Ocean Road and Environs Protection Act 2020, for "Great Ocean Road scenic landscapes area" substitute "land boundary described in subsection (4)".

62Preparation of corporate planning documents by the Authority"
(1)The board of the Authority must prepare an annual corporate plan setting out the Authority's work program and actions for the next financial year for the approval of the Minister.
(2)The Minister, by written notice, may specify—
(a)the date by which the annual corporate plan is to be provided to the Minister; and
(b)the information to be included in the annual corporate plan and the form in which that information must be presented.
(3)The Minister, by written notice, may request the Authority to prepare either or both of the following for the Minister's approval—
(a)a statement of corporate intent;
(b)a business plan.
(4)A request under subsection (3) must specify—
(a)the date by which the statement or plan must be provided to the Minister; and
(b)the information to be included in the statement or plan and the form in which that information must be presented.
(5)The Authority must comply with a request under subsection (3).
(6)A corporate planning document prepared by the Authority under this section may be amended at any time by the Authority with the approval of the Minister.
(7)The Minister, by written notice, may direct the Authority to amend a corporate planning document prepared by the Authority under this section at any time.
(8)The Authority must comply with a direction under subsection (7).
(9)The Authority must not publish a corporate planning document to which this section applies without the prior consent of the Minister.
62AAAuthority to notify Minister of significant affecting events etc.
(1)The Authority must immediately notify the Minister if the Authority is of the opinion that matters have arisen that may prevent or significantly affect the achievement of—
(a)the objects of the Authority; or
(b)financial targets, if any, under a corporate planning document.
(2)In a notification under subsection (1), the Authority must set out the reasons for the opinion.".
40New Division 3 of Part 5A inserted
After section 62P of the Great Ocean Road and Environs Protection Act 2020 insert—
"Division 3—Land management strategy
62PAPreparation of land management strategy
(1)The Authority must prepare a strategy that sets out the general long-term directions, strategies and priorities for the protection, management and use of public land in relation to which the Authority is the land manager (however described) under this or any other Act.
(2)A strategy prepared under subsection (1) must—
(a)be consistent with—
(i)the legislation under which the land is managed and any other legislation applying to the land; and
(ii)any government policies applying to the land; and
(b)address any matters specified by the Minister—
(i)in a direction given under section 53; or
(ii)in a statement of obligations.
(3)The Minister must specify a date on or before which the Authority must prepare the first strategy under this section.
62PBPreparation of amendment of the strategy
The Authority may prepare an amendment of the land management strategy at any time, including by making amendments arising from any review of the strategy under section 62PG.
62PCProcess for preparing the strategy or an amendment
(1)Before a strategy is prepared under section 62PA or an amendment is prepared under section 62PB, the Authority must—
(a)consult with—
(i)any Department or public authority whose interests may be affected by the strategy or amendment; and
(ii)any specified aboriginal party for any area affected by the strategy or amendment; and
(b)make a draft of the strategy or amendment available for inspection by the public for at least 28 days before it is prepared; and
(c)publish a notice in a newspaper circulating generally in the State setting out where and when the draft can be inspected and inviting public comment by the date specified in the notice; and
(d)publish the draft on the Internet site of the Authority; and
(e)have regard to any submissions made to the Authority on the draft strategy or amendment by the date specified in the notice.
(2)Subsection (1) does not apply to any amendment of the land management strategy that is of a machinery, declaratory or minor and technical nature.
62PDApproving the strategy or an amendment
(1)After a strategy is prepared under section 62PA or an amendment of the land management strategy is prepared under section 62PB, the Authority must submit the strategy or amendment to the Minister.
(2)After receiving a strategy or amendment under subsection (1), the Minister may—
(a)approve the strategy or amendment; or
(b)direct the Authority to alter the strategy or amendment and resubmit the strategy or amendment to the Minister.
(3)The Authority must comply with a direction of the Minister under subsection (2) within 60 days of receiving the direction, or any longer period specified by the Minister.
62PEPublication and notice of the strategy or amendment
(1)As soon as possible after the Minister approves the strategy under section 62PD, the Authority must publish—
(a)the strategy on the Internet site of the Authority; and
(b)notice of the Minister's approval in the Government Gazette.
(2)As soon as possible after the Minister approves an amendment of the land management strategy under section 62PD, the Authority must publish—
(a)the land management strategy as so amended on the Internet site of the Authority; and
(b)notice of the Minister's approval in the Government Gazette.
62PFTaking effect of the strategy or amendment
(1)A land management strategy that has been approved under section 62PD has effect on the day on which notice of the approval is published in the Government Gazette.
(2)An amendment of a land management strategy that has been approved under section 62PD has effect on the day on which notice of the approval of the amendment is published in the Government Gazette.
62PGReview of the strategy
(1)The Authority must review the land management strategy—
(a)at least every 10 years after the first strategy has effect; and
(b)as soon as possible after the making of the statement of obligations or any amendment of the statement of obligations; and
(c)at any other time if so directed by the Minister.
(2)A review under subsection (1)(a) must be commenced on or before the day on which the previous 10 year period ends.
(3)In conducting a review of the strategy, the Authority must—
(a)consult with—
(i)any Department or public authority whose interests may be affected by the strategy; and
(ii)any specified aboriginal party for any area affected by the strategy; and
(iii)the public; and
(b)consider the results of any consultation under paragraph (a).
(4)After conducting a review of the strategy, the Authority may propose to the Minister—
(a)that the Authority should—
(i)prepare an amendment to the strategy; or
(ii)revoke the strategy and prepare a new strategy; or
(b)that no amendment is required to the strategy.
(5)After receiving a proposal from the Authority under subsection (4), the Minister may—
(a)approve the proposal; or
(b)refuse to approve the proposal.
(6)If the Minister refuses to approve the proposal under subsection (5)(b), the Minister may—
(a)direct the Authority to prepare an amendment to the strategy or revoke the strategy and prepare a new strategy; or
(b)determine that no amendment is required to the strategy.
(7)A reference to an amendment under subsection (4)(b) or (6)(b) does not include an amendment of a minor and technical nature.
(8)If the Minister requires the Authority to prepare a land management strategy or an amendment to the land management strategy under subsection (6), the provisions of this Division apply to the preparation of the strategy or amendment.
62PHRevoking the strategy
The Authority may revoke the land management strategy if—
(a)the Authority has proposed that the strategy be revoked under section 62PG(4)(a)(ii) and the Minister has approved the proposal under section 62PG(5)(a); or
(b)the Minister has directed that the strategy be revoked under section 62PG(6)(a).".

(5)If the Minister specifies a period or date under subsection (4), the specification must apply to all responsible entities.
(6)If the Minister specifies a period or date under subsection (4), the Minister must—
(a)notify, in writing, each responsible entity of the period or date (as the case requires); and
(b)publish notice of that period or date (as the case requires) in the Government Gazette.".

(b)all rights, easements and privileges existing or claimed either by the public or any body or person, as incident to the express or implied grant or past dedication or supposed dedication or any past user or operation of law or otherwise, in relation to the land delineated and coloured yellow on that plan, cease.
23Preservation of existing licences, permits and other authorities—Mirboo North Conservation Park
Despite anything to the contrary in this Act, any licence, permit or other authority over any part of the land described in Part 1AC of Schedule Three that was granted or issued under the Forests Act 1958 or the Land Act 1958 and that is in force immediately before the commencement of Division 4 of Part 8 of the Parks and Public Land Legislation Amendment (Central West and Other Matters) Act 2025 continues in force on and after that commencement subject to—
(a)its terms and conditions; and
(b)the provisions of the Forests Act 1958 or the Land Act 1958 (as the case requires).
Division 5—Liwik Barring Landscape Conservation Area
24Rights to cease—roads—Liwik Barring Landscape Conservation Area
On the commencement of Division 5 of Part 8 of the Parks and Public Land Legislation Amendment (Central West and Other Matters) Act 2025—
(a)the land delineated and coloured yellow on the plans lodged in the Central Plan Office and numbered N.P. 123C/1, N.P. 123J and N.P. 123K ceases to be a road or part of a road or road reserve; and
(b)all rights, easements and privileges existing or claimed either by the public or any body or person, as incident to the express or implied grant or past dedication or supposed dedication or any past user or operation of law or otherwise, in relation to the land delineated and coloured yellow on those plans, cease.
25Preservation of existing licences, permits and other authorities—Liwik Barring Landscape Conservation Area
(1)Despite anything to the contrary in this Act, any licence, permit or other authority over any part of the land specified in subclause (2) that was granted or issued under the Crown Land (Reserves) Act 1978 or the Land Act 1958 and that is in force immediately before the commencement of Division 5 of Part 8 of the Parks and Public Land Legislation Amendment (Central West and Other Matters) Act 2025 continues in force on and after that commencement subject to—
(a)its terms and conditions; and
(b)the provisions of the Act under which it was granted or issued.
(2)For the purposes of subclause (1), the following land is specified—
(a)the land described in Subdivisions 6 and 7 of Division 1 of Part 1 of Schedule Nine;
(b)the land described in Subdivisions 2, 3 and 4 of Division 2 of Part 1 of Schedule Nine.
Division 6—Baw Baw National Park
26Revocation of reserved forest—Baw Baw National Park
On the commencement of Division 6 of Part 8 of the Parks and Public Land Legislation Amendment (Central West and Other Matters) Act 2025, any land delineated and coloured pink on the plan lodged in the Central Plan Office and numbered N.P. 29/2 that is reserved forest ceases to be reserved forest.
27Rights to cease—roads—Baw Baw National Park
On the commencement of Division 6 of Part 8 of the Parks and Public Land Legislation Amendment (Central West and Other Matters) Act 2025—
(a)the land delineated and coloured yellow on the plan lodged in the Central Plan Office and numbered N.P. 29/2 ceases to be a road or part of a road or road reserve; and
(b)all rights, easements and privileges existing or claimed either by the public or any body or person, as incident to the express or implied grant or past dedication or supposed dedication or any past user or operation of law or otherwise, in relation to the land delineated and coloured yellow on that plan, cease.
Division 7—Other parks
28Rights to cease—roads—Brisbane Ranges National Park
On the commencement of section 82 of the Parks and Public Land Legislation Amendment (Central West and Other Matters) Act 2025—
(a)the land delineated and coloured yellow on the plan lodged in the Central Plan Office and numbered N.P. 1A ceases to be a road or part of a road or road reserve; and
(b)all rights, easements and privileges existing or claimed either by the public or any body or person, as incident to the express or implied grant or past dedication or supposed dedication or any past user or operation of law or otherwise, in relation to the land delineated and coloured yellow on that plan, cease.
29Rights to cease—roads—Kinglake National Park
On the commencement of section 84 of the Parks and Public Land Legislation Amendment (Central West and Other Matters) Act 2025—
(a)the land delineated and coloured yellow on the plans lodged in the Central Plan Office and numbered N.P. 8/11 and N.P. 8A/4 ceases to be a road or part of a road or road reserve; and
(b)all rights, easements and privileges existing or claimed either by the public or any body or person, as incident to the express or implied grant or past dedication or supposed dedication or any past user or operation of law or otherwise, in relation to the land delineated and coloured yellow on those plans, cease.
30Rights to cease—roads—Cathedral Range State Park
On the commencement of section 86 of the Parks and Public Land Legislation Amendment (Central West and Other Matters) Act 2025—
(a)the land delineated and coloured yellow on the plan lodged in the Central Plan Office and numbered N.P. 41/3 ceases to be a road or part of a road or road reserve; and
(b)all rights, easements and privileges existing or claimed either by the public or any body or person, as incident to the express or implied grant or past dedication or supposed dedication or any past user or operation of law or otherwise, in relation to the land delineated and coloured yellow on that plan, cease.
31Rights to cease—roads—Gippsland Lakes Coastal Park
On the commencement of section 87 of the Parks and Public Land Legislation Amendment (Central West and Other Matters) Act 2025—
(a)the land delineated and coloured yellow on the plan lodged in the Central Plan Office and numbered N.P. 46A/8 ceases to be a road or part of a road or road reserve; and
(b)all rights, easements and privileges existing or claimed either by the public or any body or person, as incident to the express or implied grant or past dedication or supposed dedication or any past user or operation of law or otherwise, in relation to the land delineated and coloured yellow on that plan, cease.".
Division 13—Water distribution works authorities and dam licences
115Water distribution works authority in relation to certain parks
(1)In section 30G(1) of the National Parks Act 1975, for "or 49" substitute ", 49 or 51".
(2)In section 30G(1) of the National Parks Act 1975, for "Part 11" substitute
"Part 1AB, 11".
116New section 30HA inserted
After section 30H of the National Parks Act 1975 insert—
30HADam licences—Pyrenees National Park"
(1)The Minister may grant a licence to any person to use land for a dam that existed immediately before the commencement of Division 2 of Part 8 of the Parks and Public Land Legislation Amendment (Central West and Other Matters) Act 2025 on any part of the land described in Part 51 of Schedule Two.
(2)A licence under subsection (1) may be granted for a term of not more than 3 years.
(3)A licence under subsection (1) is subject to—
(a)any conditions the Minister thinks fit to impose; and
(b)the payment of any fee or charge determined by the Minister.
(4)A licence under subsection (1) may be cancelled by the Minister if the holder does not comply with a condition of the licence.
(5)The holder of a licence under subsection (1) must not transfer the licence unless the holder has first obtained the consent of the Minister.".
117New section 30HB inserted
Before section 30I of the National Parks Act 1975 insert—
30HBDam licences—Hepburn Conservation Park"
(1)The Minister may grant a licence to any person to use land for a dam that existed immediately before the commencement of Division 4 of Part 8 of the Parks and Public Land Legislation Amendment (Central West and Other Matters) Act 2025 on any part of the land described in Part 1AB of Schedule Three.

PART 9—AMENDMENT OF ST. KILDA LAND ACT 1965
118Definitions
In section 2 of the St. Kilda Land Act 1965 insert the following definition—
"marina land means the land shown delineated on the plan lodged in the Central Plan Office numbered LEGL./24–029, being Crown Allotments 2013, 2014 and 2015 and part of Crown Allotment 90E, Parish of Melbourne South at St Kilda and part of Crown Allotment 90A, Parish of Melbourne South at Elwood;".
119Section 4 substituted
For section 4 of the St. Kilda Land Act 1965 substitute—
4Committee of management may grant leases of marina land"
Despite anything in any other Act and subject to section 6, the Port Phillip City Council, as committee of management, from time to time, may lease the marina land for the purposes of a marina.".
120Governor in Council to approve of leases
(1)In section 6(1)(c) of the St. Kilda Land Act 1965, for "council of the City of St. Kilda" substitute "Port Phillip City Council".
(2)In section 6(2) of the St. Kilda Land Act 1965, for "council of the City of St. Kilda" substitute "Port Phillip City Council".
121Schedule 2 repealed
Schedule 2 to the St. Kilda Land Act 1965 is repealed.
PART 10—REPEAL OF NATIONAL PARKS (AMENDMENT) ACT 1989
122Repeal of National Parks (Amendment) Act 1989
The National Parks (Amendment) Act 1989 is repealed.
Note
The repeal of the National Parks (Amendment) Act 1989 does not affect the continuing operation of the amendments made by it (see section 15(1) of the Interpretation of Legislation Act 1984).
PART 11—REVOCATION OF PROCLAMATION
123Revocation of proclamation of Mount Cole, Langi Kal Kal and Mount Mistake native game sanctuaries
The Proclamation specified in Schedule 1 is revoked.
PART 12—REPEAL OF THIS ACT
124Repeal of this Act
This Act is repealed on 5 October 2027.
Note
The repeal of this Act does not affect the continuing operation of the amendments made by it (see section 15(1) of the Interpretation of Legislation Act 1984).
