Regulation under the Parking Space Levy Act 2009.

Explanatory note

The object of this Regulation is to amend the Parking Space Levy Regulation 2019 to provide that the base rate of the levy under clause 9 for the financial year beginning 1 July 2020 is to remain the same as the base rate of the levy in the financial year beginning 1 July 2019 in response to the COVID-19 pandemic.

This Regulation is made under the Parking Space Levy Act 2009, including sections 8(2) and 14 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Parking Space Levy Amendment (COVID-19 Indexation of

Levy) Regulation 2020.

2      Commencement

This Regulation commences on the day on which it is published on the NSW legislation website.

3 Amendment of Parking Space Levy Regulation 2019

Clause 9 Base rate (section 8)

Insert after clause 9(2)—

(2A) Despite subclause (2), for the financial year beginning 1 July 2020, the base rate of the levy in relation to premises in a Category 1 or Category 2 area is the base rate of the levy that was determined in respect of the premises for the financial year beginning 1 July 2019.
