I, the Minister for Planning, make the following local environmental plan under the

Environmental Planning and Assessment Act 1979.

1      Name of Plan

This Plan is Parkes Local Environmental Plan 2012 (Amendment No 2).

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Land to which Plan applies

This Plan applies to land in Zones RU1, R1, R5, SP2 and RE1 under Parkes Local

Environmental Plan 2012.

4      Maps

The maps adopted by Parkes Local Environmental Plan 2012 are amended or replaced, as the case requires, by the maps approved by the Minister on the making of this Plan.

5 Amendment of Parkes Local Environmental Plan 2012

(1)

Land Use Table

Insert “; Water storage facilities” after “Water recreation structures” in item 3 of the matter relating to Zone RU1.

Land Use Table, Zone RE1, item 3

Insert “Caravan parks;” and “Markets;” in alphabetical order.

(3)

Clause 4.2A Erection of dwelling houses, dual occupancies (attached) and

secondary dwellings on land in Zone RU1

Omit “, and on which no dwelling house, dual occupancy (attached) or secondary dwelling has been erected,” from clause 4.2A (2).

Omit “Development consent”.

Insert instead “Despite subclause (2), development consent”.

Clause 4.2A (4), paragraph (b) of definition of “existing holding”

Omit “subclause (3)”. Insert instead “subclause (2)”.
