REGULATIONS UNDER THE PAPUA NEW GUINEA INDEPENDENCE ACT 19751

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Papua New Guinea Independence Act 1975.

PAPUA NEW GUINEA INDEPENDENCE (AUSTRALIAN CITIZENSHIP OF YOUNG PERSONS) REGULATIONS

Citation

 1. These Regulations may be cited as the Papua New Guinea Independence (Australian Citizenship of Young Persons) Regulations.

Re-acquistion of Australian citizenship lost by certain persons on Independence Day

 2. A person who on Independence Day—

  • (a)

    was under 19 years of age;

  • (b)

    was not for the purposes of section 64 of the Constitution of the Independent State of Papua New Guinea a person who was never granted a right (whether revocable or not) to permanent residence in Australia; and

  • (c)

    ceased to be an Australian citizen,

shall be deemed to have re-acquired his Australian citizenship on that day.

Loss of Australian citizenship re-acquired under regulation 2

 3. On renouncing Australian citizenship and making the Declaration of Loyalty in accordance with the Constitution of the Independent State of Papua New Guinea, a person referred to in regulation 2 ceases to be an Australian citizen.
