REGULATIONS UNDER THE PAPUA AND NEW GUINEA BOUNTIES ACT 1937.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Papua and New Guinea Bounties Act 1937.

Citation.

1. These Regulations may be cited as the Papua and New Guinea Bounties Regulations.

Definitions.

2.—(1.) In these Regulations, unless the contrary intention appears—

“bounty” means bounty under the Act;

“Collector” means Collector of Customs and includes a Sub-Collector of Customs;

“the Act” means the Papua and New Guinea Bounties Act 1937, and if that Act is at any time amended, includes that Act as so amended.

(2.) In these Regulations, any reference to a Form shall be read as a reference to a Form contained in the Schedule to these Regulations.

Notice of intention to claim bounty.

3. Every person who intends to claim bounty shall, not later than the time at which the goods on which the bounty is to be claimed are entered for home consumption in the Commonwealth, give to the Collector at the port at which the goods are so entered a notice of intention to claim bounty in accordance with Form A.

Claims for bounty.

4. Claims for bounty shall be in accordance with Form B and shall be lodged, not later than three months after the goods on which the bounty is claimed were entered for home consumption, at the office of the Collector at which the goods were so entered.

Appointment of authorized agent.

5. An exporter may, in accordance with Form C, appoint an agent—

(a) to give any notice or to make any claim on his behalf for the purposes of the Act or of these Regulations; and

(b) to receive payment of bounty on his behalf and to give an effectual receipt therefor.

Authority of agent.

6. An agent so authorized—

(a) may give any notice or make any claim on behalf of his principal for the purposes of the Act and of these Regulations; or

(b) may be paid bounty on behalf of his principal and may give a receipt therefor,

as the case may be, and any notice or receipt so given and any claim or payment so made shall be as valid and effectual as if it had been given or made by or to the principal.

Certificate of principal officer of Customs.

7. The certificate of a principal officer of Customs under paragraph (a) of section 6 of the Act may be in accordance with Form D.
