GAUDRON J:   This matter was heard in Canberra by the Chief Justice, Justices McHugh, Gummow, Kirby and I on 7 November 1997.  Although the reasons for judgment are not ready for publication, the Court is in a position to make its order which is as follows:

1.Appeal allowed.

2.Set aside the order of the Court of Appeal and in lieu thereof grant leave to appeal to that Court, allow the appeal and quash the appellant’s convictions and enter verdicts of acquittal in their place.
