HIS HONOUR:   This matter was heard in Canberra by a Court constituted by Justices Gaudron, McHugh, Gummow, Kirby and myself. 

On 2 December 1997, the following order in this appeal was made:

1.Appeal allowed.

2.Set aside the order of the Court of Appeal and in lieu thereof grant leave to appeal to that Court, allow the appeal and quash the appellant’s convictions and enter verdicts of acquittal in their place.

At that time it was stated that the reasons for judgment would be published at a later date.  The reasons for judgment are now to be published.

Justices Gaudron, Gummow and I would allow the appeal, and I publish our joint reasons.  Justice McHugh would allow the appeal, and I publish his Honour’s reasons.  Justice Kirby would also allow the appeal, and I publish his Honour’s reasons. 

The order of the Court is as it was previously announced.
