  1. The applicant seeks special leave to appeal from a decision of the Court of Appeal of the Supreme Court of Queensland. The application creates no reason to doubt the result in the Court of Appeal. It would accordingly be futile to grant the extension of time required for the application to proceed. Special leave should be refused.

  2. Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application and directing the applicant to pay the costs of the second and third respondents.
