REASONS FOR DECISION TO DISMISS OBJECTION APPLICATION
On 13 November 2002, the Government party gave notice under s 29 of the Native Title Act 1993 (Cth) of its intention to grant Exploration Licence 23335 to Astro Mining NL (‘the grantee party’) and included in the notice a statement that it considered that the grant attracted the expedited procedure.
On 13 March 2003, Paddy Carlton on behalf of the Gudim and Gurrbijim Groups and Paddy Carlton on behalf of the Gurrbijim Group (‘the native title parties’) made expedited procedure objection applications to the Tribunal.
The Department of Business, Industry and Resource Development on behalf of the Government party has advised the Tribunal that on 2 June 2003, the exploration licence application made by Astro Mining NL was withdrawn.
Decision
There is no longer any proposal from the Government party to do a future act and accordingly the objection applications are dismissed pursuant to s 148(a) of the Native Title Act 1993 (Cth).
