[ASSEN1'ED TO 30TH NOVEMBER, 1911.J B E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Council and Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows : - Short title. 1. This Act may be cited as "The Paddington Cemeteries .Act of 1911." ." Resumption or"" ' ' P&ddington Cemeteries; 2. All those parcels' of land situated in the county of Stanley, parish of North Brisbane, which are described in the Schedule to this Act, and which heretofore were granted in trust or otherwise held in possession and used for the purposes of burial grounds or cemeteries, but which have for many years ceased to be so used, are hereby resumed from the respective trustees or other the persons having in law possession of the same, and the subsisting trusts thereof are hereby determined. - From and after the passing of this Act, all such parcels of land shall become Crown land, -and shall be ,dealt with under this Act. A.ssets and liabilities. 'rhe Deeds of Grant numbered respectively 3754,- 79644,79645, Sn77, and 17772, issued-in respect of certain of the said parcels of land, are cancelled. • 3. All assets and liabilities of or attaching to the trustees or other the persons in possession of the said parcels of land in connection with the same shall, from and after the passing of this Act, pass to and be vested in and shall be discharged by the Secrptary for Public Lands as representing His Majesty.

The Se.cretary for Public J.. ands, upon the applica- Right to tion of any of the relatives of any deceased persons who ~ ~ : : : b: ~ ones have been interred in any of the said cemeteries made and remains. within twelve months after the passing of this Act, .shall exhume the remains of such deceased persons (so far as such remains can by reasonable diligence be discovered) and remove the same, together with any monuments, tombstones, or other memorials of such deceased persons, to the Toowong Cemetery or some other cemetery agreed upon with such relatives, and shall there cause such remains to be reverently reinterred. 5. The said parcels of land shall be reserved for such Lands to be public purposes under" Tlte Land Act of 1910 ,,* as the reserved. Governor in Council shall think fit : Provided that, in order to prevent any disturbance of public worship in the church erected on subdivision 633B .and used by members of the Church of England, a part of the land comprised in Deed of Grant No. 3754, referred to in the Schedule to this Act as the Episcopalian Burial Ground-that is to say, such area thereof as is comprised in a parallelogram immediately bounded on the south by subdivisions 633A, 6330, and 633B, and having a frontage of half a chain to Hale street-shall be reserved from public use, and shall be placed under the control of trustees either permanently or temporarily as theGovernor in Council may direct. . 6. The expenses incurred by the Secretary for Public ~ ppropl' ia Lands in the execution of' this Act shall he defrayed vl~n. out of the Consolidated Revenue Fund, which is hereby appropriated for the purpose. .. 1 Geo.
