An Act to impose a charge on Imported Pack­

ages. [20th June, 1865.]
BE it enac ted b y t h e Queen ' s Most Exce l l en t Majesty by and t he advice and consent of t h e Legislat ive Council and Legislat ive

wi th

Assembly of N e w South W a l e s in Pa r l i amen t assembled a n d by the
au thor i ty of t h e same as follows :—

1. The re shall be charged (irrespective of any dut ies of Cus toms now payable by law) upon t h e impor ta t ion of all goods in to t h e Colony t h e r a t e of one shi l l ing for every package or parcel except goods in t r ans i t live stock flour whea t sugar and tea and except as hereinafter provided for.

2. For t h e purposes of th is Ac t t h e quant i t ies respectively of
t he art icles s ta ted in t h e following list shall be deemed to be parcels
a n d shal l be subject to t h e charge of one shil l ing each on impor t a t ion :—

B r a n a n d pollard twenty-five bushels
Br icks and t i les t h ree h u n d r e d

Cocoanuts one thousand

art icles impor ted shall be deemed a parce l Provided also t h a t on t h e

impor ta t ion of any goods in bu lk no t he re in enumera t ed i t shall be lawful for t he Colonial Treasurer or t h e Collector of Cus toms to fix or adjust t h e quan t i t y which shall cons t i tu te a package chargeable w i th

t h e r a t e of one shi l l ing unde r t h i s Act .
3 . The impor te r of any goods l iable to t he ra te of one shi l l ing

pe r package shall a t t h e t ime of en t ry or before delivery of such goods furnish par t icu la rs of t he same and shall m a k e and subscribe if r equ i red a declarat ion of t he t r u t h of such par t i cu la rs and t h e same m a y be wr i t t en on t h e e n t r y or o ther document t endered wi th t h e sum payable in respect of such package charge or in case of en t ry by bill of s ight or b y imperfect en t ry for t h e purpose of c lear ing the ship t h e n on t h e perfect en t ry a t t he t ime of perfect ing such en t ry and in the la t t e r cases t h e charge of one shil l ing per package shal l be paid before t he delivery of t h e goods a n d if such pa r t i cu la r s shall be u n t r u e t he person m a k i n g such declarat ion shal l forfeit a n d pay a pena l ty of forty shil l ings.

4 . Every person w ho shall on or before t h e pass ing of th i s A c t have made or en te red in to any cont rac t Or agreement for t h e sale or delivery upon or a t any t ime after such day of any ar t ic le whe reupon any charge on impor ted packages shall be payable unde r t he provisions of th i s A c t shall be a t l iber ty to add to the pr ice cont rac ted for so m u c h money as will be equiva lent to t h e addi t ional charge which shall by reason of such provisions have been paid or made payable on such packages and shall be ent i t led by v i r tue of th i s A c t to be paid t h e same accordingly by t h e purchaser of such package and to sue for and recover t h e same agains t such purchase r Provided tha t in every case where

t h e pr ice cont rac ted for shall be so added to i t shall be a t t he opt ion
of such purchaser by not ice in wr i t ing u n d e r his h a n d to be served

on t h e other par ty to such contract w i th in fourteen days after t h e pass ing of th i s Ac t to declare t h e cont rac t null and void and t h e same

shal l be nu l l a n d void accordingly.

5. This A c t shall be deemed to have come in to operat ion on

t h e twenty-fifth day of M a y one thousand eight h u n d r e d a n d sixty-
five a n d shall cont inue in force u n t i l t h e thir ty-first day of December
one thousand e ight h u n d r e d and sixty-seven and m a y be cited as the

" Package A c t of 1865 . "
