Ozone Protection (Product Control) Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Ozone Protection Act 1989.

1.   Commencement

1.1   These Regulations, except subregulations 3.2 and 3.4, commence on 15 August 1994.

1.2   Subregulations 3.2 and 3.4 commence on 31 December 1994.

2.   Amendment

2.1   The Ozone Protection (Product Control) Regulations are amended as set out in these Regulations.

3.   Regulation 7 (Refrigeration and air conditioning equipment)

3.1   Subregulation 7 (1):

Omit “that is intended to be used for commercial or industrial purposes”.

3.2   Subregulation 7 (1):

Add at the end:

  • “; or (c)

    the equipment is insulated with foam manufactured with a CFC.”.

3.3   Subregulation 7 (2):

Omit “that is intended to be used for commercial or industrial purposes”.

3.4   Subregulation 7 (2):

Add at the end:

  • “; or (c)

    the equipment is insulated with a foam manufactured with a CFC.”.

3.5   Subregulation 7 (3):

Omit the subregulation, substitute:

“(3)

Subregulations (1) and (2) do not apply to:

  • (a)

    spare parts, except compressors, for refrigeration equipment designed for domestic purposes; and

  • (b)

    insulation foam that is:

    • (i)

      manufactured with a CFC; and

    • (ii)

      designed for use in refrigeration or air conditioning equipment for commercial or industrial purposes.”.

4.   Schedule

4.1   Omit the Schedule.
