Ozone Protection (HCFC, HBFC and Methyl Bromide) Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Ozone Protection Act 1989.

1.   Amendment

1.1   The Ozone Protection (HCFC, HBFC and Methyl Bromide) Regulations are amended as set out in these Regulations.

[NOTE: These Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48.]

2.   New Part heading

2.1   Before regulation 1, insert:

PART 1—PRELIMINARY”.

3.   Regulation 2 (Commencement)

3.1   Omit the regulation, substitute:

Commencement

(1) These Regulations, except Part 3, commence on 1 November 1994.

“(2)

Part 3 of these Regulations commences on 1 January 1995.”.

4.   Part 1 (Licences)

4.1   Omit the heading, substitute:

PART 2—LICENCES”.

5.   Regulation 15 (Renewal of licence)

5.1   Subregulation 15 (2):

Omit the subregulation, substitute:

“(2)

The application must be:

  • (a)

    made to the Minister; and

  • (b)

    in accordance with Form 3 in Schedule 2.”.

6.   Regulation 16 (Cancellation of licence)

6.1   Subregulation 16 (4):

Omit “subregulation (4)”, substitute “subregulation (3)”.

7.   Part 2 (Restrictions on import and export of HBFC’s)

7.1   Omit the heading, substitute:

PART 3—RESTRICTIONS ON IMPORT AND EXPORT OF HBFCs”.

8.   Part 3 (Records and reports)

8.1   Omit the heading, substitute:

PART 4—RECORDS AND REPORTS”.

9.   Part 4 (Miscellaneous)

9.1   Omit the heading, substitute:

PART 5—MISCELLANEOUS”.

10.   Regulation 30 (Review of decisions)

10.1   Omit the regulation, substitute:

Review of decisions

“30.

Application under the Administrative Appeals Tribunal Act 1975 may be made to the Administrative Appeals Tribunal for a review of a decision of the Minister:

  • (a)

    to refuse to grant a licence under regulation 10 or 11; and

  • (b)

    to specify, impose, revoke or vary a licence condition under regulation 12; and

  • (c)

    to refuse to renew a licence under subregulation 15 (6), (7) or (8); and

  • (d)

    to cancel a licence under regulation 16.”.

11.   Schedule 1

11.1   Omit the heading, substitute:

SCHEDULE 1 Regulation 3 and paragraphs

 9 (3) (a) and 12 (3) (a), (b)

  and (d)
