Select Legislative Instrument 2012 No. 111

I, QUENTIN BRYCE, Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following regulation under the Ozone Protection and Synthetic Greenhouse Gas (Manufacture Levy) Act 1995.

Dated 14 June 2012

QUENTIN BRYCE

Governor-General

  1. Name of regulation

This regulation is the Ozone Protection and Synthetic Greenhouse Gas (Manufacture Levy) Amendment Regulation 2012 (No. 1).

  1. Commencement

This regulation commences on 1 July 2012.

  1. Amendment of Ozone Protection and Synthetic Greenhouse Gas (Manufacture Levy) Regulations 2004

Schedule 1 amends the Ozone Protection and Synthetic Greenhouse Gas (Manufacture Levy) Regulations 2004.

Schedule 1          Amendment

(section 3)

[1]          Regulation 5

substitute

  1. Value for calculation of carbon dioxide equivalence of an amount of SGG

(1)For subsection 2B (1) of the Act, the value is the global warming potential amount in the following table for a kind of SGG.

Item

Kind of SGG

Global warming potential (Value)

Hydroflurocarbons

1 HFC-23 (CHF3) 11 700
2 HFC-32 (CH2F2) 650
3 HFC-41 (CH3F) 150
4 HFC-43-10mee (C5H2F10) 1 300
5 HFC-125 (C2HF5) 2 800
6 HFC-134 (C2H2F4 (CHF2CHF2)) 1 000
7 HFC-134a (C2H2F4 (CH2FCF3)) 1 300
8 HFC-143 (C2H3F3 (CHF2CH2F)) 300
9 HFC-143a (C2H3F3 (CF3CH3)) 3 800

10

HFC-152a (C2H4F2 (CH3CHF3))

11

HFC-227ea (C3HF7)

2 900

12

HFC-236fa (C3H2F6)

6 300

13

HFC-245ca (C3H3F5)

Perflurocarbons

14 Perfluromethane (tetrafluromethane) (CF4) 6 500
15 Perfluroethane (hexafluroethane) (C2F6) 9 200
16 Perfluropropane (C3F8) 7 000
17 Perflurobutane (C4F10) 7 000
18 Perflurocyclobutane (c-C4F8) 8 700
19 Perfluoropentane (C5F12) 7 500
20 Perfluorohexane (C6F14) 7 400

Sulfur hexafluoride

21 Sulfur hexafluoride (SF6) 23 900

Note   The values in the table are derived from table 4 on page 22 of Climate Change 1995—The Science of Climate Change: Contribution of Working Group I to the Second Assessment Report of the Intergovernmental Panel on Climate Change, published in 1996 by Cambridge University Press.

In 2012, the report was available online at

(2)If an SGG is composed of more than one kind of SGG, for each component that is specified in the table:

(a)the value is worked out separately; and

(b)the value is the amount specified in the table for the component.

Example   R410A is composed of 50% of HFC-32 and 50% of HFC-125. If a person imports 1 kilogram of R410A, the SGG amount in metric tonnes of the component will be 50% multiplied by 0.001, multiplied by the value for the component HFC-32 specified (650) (which equals 0.325 tonnes), plus 50% multiplied by 0.001, multiplied by the value for the component HFC‑125 specified (2 800) (which equals 1.4 tonnes) to equal the carbon dioxide equivalence of 1.725 tonnes for the 1 kilogram of R410A.

  1. Manufacture levy rate—SGGs

For the definition of prescribed rate in subsection 3A (5) of the Act, the rate is $165 per tonne.

  1. Manufacture levy rate—substances other than SGGs

For subsection 4 (1) of the Act, the following rates of levy are prescribed:

(a)for HCFCs—$3 000 per ODP tonne;

(b)for methyl bromide—$135 per tonne.
