Ozone Protection (Amendment) Act 1996

An Act to amend the Ozone Protection Act 1991 and for related purposes

The Legislative Assembly for the Australian Capital Territory enacts as follows:

Short title

1.  This Act may be cited as the Ozone Protection (Amendment) Act 1996.

Commencement

2.  (1)  This Act, other than section 4, commences on the day on which it is notified in the Gazette.

(2)  Section 4 commences on 1 January 1997.

Principal Act

3.  In this Act, “Principal Act” means the Ozone Protection Act 1991.1

Prohibition on service of article containing ozone depleting substance

4.  Section 7 of the Principal Act is amended by omitting the penalty provision and substituting the following penalty provision:

“Penalty:

(a)if the offender is a natural person—50 penalty units or imprisonment for 6 months, or both;

(b)if the offender is a body corporate—250 penalty units.”.

Amendments—Ozone Protection (Amendment) Act 1995

5.  (1) Section 2 of the Ozone Protection (Amendment) Act 1995 is amended by omitting subsection (2).

(2) Section 5 of the Ozone Protection (Amendment) Act 1995 is repealed.
