Descriptions) Regulation 1998

Ozone Protection Act 1989

His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Ozone Protection Act 1989.

Explanatory note

The object of this Regulation is to amend the Ozone Protection Regulation 1997 in connection with the commencement of the Protection of the Environment Operations Act 1997 (the “new Act”).

Provisions relating to the issuing of penalty notices for offences under the Ozone Protection Act 1989 and the Ozone Protection Regulation 1997 are to be removed from that Regulation and dealt with in regulations under the new Act.

This Regulation also makes a consequential amendment to clause 20 of the Ozone Protection Regulation 1997 (Cancellation of authorisations) to ensure

it refers to the new Act.

This Regulation is made under the Ozone Protection Act 1989, including section 30 (the general regulation-making power).

1 Name of Regulation

This Regulation is the Ozone Protection Amendment (Penalty

Notices and Short Descriptions) Regulation 1998.

2 Commencement

This Regulation commences on the commencement of the
Protection of the Environment Operations Act 1997.

3 Amendment of Ozone Protection Regulation 1997

The Ozone Protection Regulation 1997 is amended as set out in

Schedule 1.

4 Notes

The explanatory note does not form part of this Regulation.

(Clause 3)

[1] Clause 20 Cancellation of authorisations

Omit “section 6A of the Environmental Offences and Penalties Act
1989” from clause 20 (1) (b).
Insert instead “section 117 of the Protection of the Environment

Operations Act 1997”.

[2] Clauses 42 and 43

Omit the clauses.

[3] Schedule 2 Penalty notice offences

Omit the schedule.
