AN ACT to amend " An Ordinance for protecting the

Oyster Fisheries on the Coasts of this Colony."

[ 17th January, 1871. ]

HEREAS by the first section of an Ordinance framed in the

28th year of Her Most Gracious Majesty Queen Victoria, Oyster Fisheries on the Coasts of this Colony," it is enacted that if any person or persons shall at any time between the fifteenth day of August and the fifteenth day of December in any year, or between such other dates as shall from time to time be notified in the	Preamble.
Government Gazette, with or by means of any net, trawl, dredge, or
other instrument or engine whatsoever, take or catch any Oyster or Oyster Brood within the limits of any Oyster fishery, sound, bay, creek, river, or harbor of this Colony, or shall dredge for Oysters or Oyster Brood, or use any oyster dredge, or any net, instrument, or engine whatsoever, within any sound, bay, creek, river, or harbor, for the purpose of taking or catching any Oysters or Oyster Brood,

though none shall be actually taken, or shall sell, dispose of; exchange, or barter for valuable consideration, any such Oyster or Oyster Brood, shall be guilty of a misdemeanour, and -Upon conviction before any Justice of the Peace, shall be liable to a fine not exceeding Five pounds, or to be imprisoned, with or without hard labour, for any period not exceeding three calendar months. And whereas experience has led to the belief that the dates named in such section do not include those times when Oyster fishing should be rendered illegal, and that it is advisable to alter those dates ; Be it enacted, by His Excellency The Governor of Western Australia and its Dependencies, by and with the advice and consent of the Legislative Council thereof; and by Authority of the same, as follows :—

Repeal of dates in Sec. 1 of 1 THAT the dates named in the first section of the Ordinance

and substitution of others. fifteenth day of December in any year, be and are hereby repealed, Ordinance No. 4 of 1864, No. 4 of 1864, viz., between the fifteenth day of August and the

and that the following dates be substituted in lieu thereof, viz :— between the first day of November in any year and the twenty- eighth day of February next succeeding such date.
