Overseas Students Charge Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Overseas Students Charge Act 1979.

Commencement

1. These Regulations shall come into operation on 1 January 1986.

Amount of charge

2. Regulation 3 of the Overseas Students Charge Regulations is amended by omitting paragraphs (1) (a), (b) and (c) and substituting the following paragraphs:

“(a) in respect of a student who is enrolled in a prescribed course that commenced before 1 January 1986 and ends in a year after that date

(i) in the case of a student who is enrolled in a course of study in medicine, veterinary science or dentistry $3,565; and

(ii) in any other case—$2,875; and

(b) in respect of a student who enrols in a prescribed course that commences on or after 1 January 1986—

(i) in the case of a student who enrols in a course of study in medicine, veterinary science or dentistry $4,340; and

(ii) in any other case $3,500.”.

3. After regulation 3 of the Overseas Students Charge Regulations the following regulation is inserted:

Transferred course, &c.

“3a. Where a student

(a) who was enrolled in a prescribed course before 1 January 1986 has, on one or more occasions, transferred his or her enrolment to another prescribed course; or

(b) whose enrolment in a prescribed course is or was interrupted by a period of deferment approved by the prescribed educational institution offering the course, and the enrolment is resumed in accordance with the terms of the approval as specified at the time of the giving of the approval.

the amount of charge in respect of that enrolment for a year commencing on or after 1 January 1986 is the amount referred to in sub-paragraph 3 (1) (a) (i) or (ii), as the case requires.”.

Schedule

4. The Schedule to the Overseas Students Charge Regulations is repealed and the following Schedule substituted:
