Overseas Students Charge Regulations2

(Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council and pursuant to section 4 of the Acts Interpretation Act 1901,hereby make the following Regulations under the Overseas Students Charge Act 1979.

Principal Regulations

1. In these Regulations, “Principal Regulations” means the Overseas Students Charge Regulations.

Interpretation

2. Regulation 2 of the Principal Regulations is amended by omitting the definition of “preliminary course” and substituting the following definition:

“ ‘preliminary course’ means a course of study of the kind described in paragraph (b) of the definition of ‘university or advanced education course’ in sub-section 4 (1) of the Act;”.

Reductions in amounts of charge imposed

3. Regulation 3 of the Principal Regulations is amended—

(a) by omitting sub-regulation (1);

(b) by omitting from sub-regulation (2) “Notwithstanding the provisions of sub-regulation (1), where” and all words from and including “the amount of the charge” and substituting “Where” and “the amount of charge imposed by the Act in respect of that enrolment is reduced by half” respectively;

(c) by omitting from sub-regulation (3) “Notwithstanding the provisions of sub-regulation (1), where” and all words from and including “the amount of the charge” and substituting “Where” and “the amount of charge imposed by the Act in respect of the enrolment of the student in that course for the year in which the student commences that course is reduced by half respectively; and

(d) by omitting from sub-regulation (4) “Notwithstanding the provisions of sub-regulation (1), where” and all words from and including “the amount of the charge” and substituting “Where” and “the amount of charge imposed by the Act in respect of the enrolment of the student in that course for the year in which the student completes that course is reduced by half” respectively.

Course of study declared to be a university or advanced education course

4. Regulation 5 of the Principal Regulations is amended—

(a) by omitting from paragraph (a) “prescribed educational institution” and substituting “university or college of advanced education”; and

(b) by omitting all words from and including “a prescribed course” and substituting “, in relation to the student referred to in paragraph (c), a university or advanced education course for the purposes of paragraph (c) of the definition of ‘university or advanced education course’ in sub-section 4 (1) of the Act”.
