Overseas Students Charge Regulations 2 (Amendment)
I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with
the advice of the Federal Executive Council, hereby make the following
Regulations under the

1. These Regulations shall come into operation on 1 January 1983.
“2a. A course of study specified in column 2 of an item in the Schedule, being a course offered or to be offered by the institution specified in column 3 of that item opposite to that course in column 2, is declared to be a declared course for the purposes of the Act.”.
(a) by omitting from paragraph (1) (b) “$2,200” and substituting “$2,350”;
(b) by omitting from paragraph (1) (c) “$1,700” and substituting “$1,850”;

(c) by omitting from paragraph (2) (d) “or”;
(d) by inserting after paragraph (2) (e) the following word and paragraph:
“; or (f) is enrolled in a course the duration of which does not exceed 12 months, being a course that commences in a year and finishes in the next succeeding year,”; and
(e) by adding at the end thereof the following sub-regulations:
“(3) Notwithstanding the provisions of sub-regulation (1), where a student is enrolled in a course that—
(a) commences on or before 30 June in a year;
(b) is of more than 12 months’ duration; and
(c) ends in the same calendar month as the month in which it commenced,
the amount of the charge in respect of the course in respect of the year in which the student commences the course is one-half of the amount that would, but for this sub-regulation, be payable in respect of the course.
“(4) Notwithstanding the provisions of sub-regulation (1), where a student is enrolled in a course that—
(a) commences after 30 June in a year;
(b) is of more than 12 months’ duration; and
(c) ends after 31 July in a year,
the amount of the charge in respect of the course in respect of the year in which the student completes the course is one-half of the amount that would, but for this sub-regulation, be payable in respect of the course.”.
4. Regulation 4 of the Overseas Students Charge Regulations is amended—(a) by omitting “sub-section 7 (2)” and substituting “sub-sections 7 (2) and 7a (3)”; and
(b) by adding at the end of sub-paragraph (c) (ii) “or conferred by a declared course”.
