Otto v Mackay Sugar Ltd

Otto brought an action against Mackay Sugar Ltd for damages resulting from personal injuries sustained at work. The injuries developed over a period of time, and the applicant had previously lodged an application for compensation for an injury to his lower back. The primary issue for the court was whether the injury referred to in the compensation application was the same injury for which common law damages were being sought.
