1  Name

This instrument is the Other Grants Guidelines (Education) Amendment (Women in STEM Program Enhanced Flexibility) 2021.

2  Commencement

(1)  Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

This instrument is made under section 238-10 of the Higher Education Support Act 2003.

The instrument specified in the Schedule to this instrument is amended as set out in the Schedule.

Schedule 1—Amendments

Other Grants Guidelines (Education) 2012

1  Paragraph 1.180.1(b)

Omit “paragraph”, substitute “subsection”.

2  Section 1.190

Insert after subsection 1.190.5:

Additional equality of opportunity payment

1.190.6        A provider may be awarded an extra amount, as specified in the deed of agreement with the Commonwealth, for the purposes of promoting equality of opportunity in higher education.

3  Subsection 1.190.15

Omit “subsection”, substitute “section”.

4  Paragraph 1.190.15(c)

Omit “that is specified under 1.180.1 and is in receipt of a grant.”, substitute “that agrees with the provider or with the Commonwealth to release those persons for study purposes over the duration of the course.”.

5  Subsection 1.190.30

Insert after paragraph 1.190.30(a):

(aa) the provider’s compliance with the conditions applicable to its use of the additional equality of opportunity payment set out in the deed, if applicable;  

6  Section 1.195

Insert before subsection 1.195.1:

1.195.1A      A grant to an employer under the Women in STEM Cadetships and Advanced Apprenticeships Program must be used to achieve the objective listed in subsection 1.175.1.

7  Subsection 1.195.20

Repeal 1.195.20, substitute:

1.195.20      Grants must be used to facilitate and support the provision of higher education, specifically one or more of the following:

(a) to provide flexible working arrangements to support the provision of higher education and enable employees to undertake study;

(b) to collaborate with higher education providers on the development or design of courses of study;

(c) work-based assessment;

(d) supervision;

(e) providing study equipment and resources;

(f)  reimbursing employees for expenses relating to their study;

(g) work integrated learning; and

(h) associated program administration.
