Orica Australia Pty Ltd sought a declaration that certain of its employees were eligible for long service leave under the Coal Mining Industry (Long Service Leave) Administration Act 1992 (Cth). The Coal Mining Industry (Long Service Leave Funding) Corporation opposed the application, arguing that the employees were not engaged in the black coal mining industry. The matter was heard in the Federal Court of Australia. The court was tasked with determining the scope of the definition of ‘black coal mining industry’ in the Black Coal Mining Industry Award 2010, particularly in light of clause 4.3(g), and applying it to ascertain whether Orica Australia Pty Ltd's employees were engaged in that industry for the purposes of being eligible for long service leave.
The court considered the substantial character test for determining whether an employee is engaged in the black coal mining industry. It examined the nature of Orica Australia Pty Ltd's operations and the activities of its employees. The court found that while some of Orica Australia Pty Ltd's employees were involved in activities that were clearly part of the black coal mining industry, others were not. The court held that the test for determining eligibility was whether the employee’s work had the character of black coal mining, and not whether it was incidental or ancillary to such work. Consequently, not all of Orica Australia Pty Ltd's employees met the criteria for being considered ‘engaged’ in the black coal mining industry.
The Federal Court held that the Corporation was correct in its opposition to Orica Australia Pty Ltd's application for a declaration of eligibility for long service leave for all of its employees. The court found that only those employees who were engaged in activities that had the substantial character of black coal mining were eligible. The court declined to make a declaration in favour of Orica Australia Pty Ltd and ordered that the costs of the proceeding to date be reserved.
