Queensland Subordinate Legislation 1991 No. 37 Fauna Conservation Act 1974 ORDER IN COUNCIL At the Executive Building, Brisbane, the first day of August, 1991 Present: His Excellency the Administrator of the Government in Council HIS Excellency the Administrator of the Government, acting by and with the advice of the Executive Council, and in pursuance of the FaunaConservation Act 1974 , amends the Order in Council made under section 29 of that Act on 29 November 1990 as follows. Paragraph (a) commencing “Eastern Grey Kangaroo”— 1. Omit all words from and including ‘the fauna districts’ to and including ‘Woongarra’ at the end of that paragraph, insert— ‘all districts other than the districts of Albert, Atherton, Aurukun, Brisbane City, Cairns City, Caloundra City, Charters Towers City, Cook, Dalby Town, Douglas, Eacham, Gladstone City, Gold Coast City, Goondiwindi Town, Gympie City, Herberton, Hervey Bay City, Hinchinbrook, Ipswich City, Johnstone, Landsborough, Logan City, Mackay City, Mareeba, Maroochy, Maryborough City, Mornington, Mulgrave, Nebo, Noosa, Pine Rivers, Redcliffe City, Redland, Rockhampton, Roma Town, Thuringowa City, Toowoomba City, Torres, Townsville City, Warwick City, Whitsunday, Widgee and Woongarra’. Clause (5)— 5. Omit paragraphs (d) and (e), insert— ‘ (d) in the case of a carcass of— (i) a male animal—either beside the animal’s penile sheath or through the animal’s scrotal stalk; or (ii) a female animal—in the animal’s neck or butt; or (e) in the case of a skin of— (i) a male animal—either beside the animal’s penile sheath or through the animal’s scrotal stalk; or (ii) a female animal—in the animal’s neck; and’. Clause 6— 6. Omit, insert — ‘(6) An open season fauna permit holder who takes open season fauna for sale must ensure that sufficient of the penile sheath or scrotal stalk of male fauna, or the urogenital opening of female fauna, to enable the fauna to be sexed, remains securely attached to the tagged skin or carcass of the fauna.’. Clause (7)(b)— 7. After ‘sale;’, insert ‘or

4 Order under Fauna Conservation Act 1974 (c) to the depot of a person permitted under the State Transport Act1960 to carry goods, for consignment to the registered premises of the holder of a fauna dealer’s licence Class “A”;’.
