Order amending Water Sharing Plan for
the Upper Namoi and Lower Namoi

Water Sharing Plan for the Upper Namoi and Lower Namoi Regulated River Water
Sources 2003
PURSUANT to section 45 (1) (a) of the Water Management Act 2000, I, PHILLIP
COSTA, MP, Minister for Water, with the concurrence of the Minister for Climate
Change and the Environment, being satisfied it is in the public interest to do so, do,
by this Order, amend the Water Sharing Plan for the Upper Namoi and Lower Namoi
Regulated River Water Sources 2003 in the manner set out in Schedule 1.
This Order takes effect from the date it is published in the NSW Government Gazette.

Omit clause 45. Insert instead:

Carrying over of water allocation credits and water allocation account limits
(1) Water allocation remaining in the water allocation accounts of domestic and stock, local water utility and regulated river (high security) access licences in the Upper Namoi Regulated River Water Source cannot be carried over from one water year to the next. (2) The following rules shall apply to the management of water allocations in the water allocation accounts of regulated river (general security) access licences in the Upper Namoi Regulated River Water Source:
(a) water allocations remaining in the water allocation account may be carried over from one water year to the next up to a limit that is equal to 0.5 megalitre per unit of share component specified on the respective access licence, and (b) the maximum volume that may be held in the water allocation account at any time shall be equal to: (i) 1 megalitre per unit of share component specified on the respective access licence,
(ii) plus any water allocations assigned from another access licence in that water year,
(iii) minus any water allocations assigned to another access licence in that water year.
(3)
The following rules shall apply to the management of water allocation in the water allocation accounts of domestic and stock access licences, local water utility access licences and regulated river (high security) access licences in the Lower Namoi Regulated River Water Source:
(a)
the maximum volume that may be held in the accounts of domestic and stock access licences and local water utility access licences at any time shall be equal to 100% of the access licence share component,
(b)
the maximum volume that may be held in the accounts of regulated river (high security) access licences at any time shall be equal to 1 megalitre multiplied by the number of unit shares specified in the share component, and

water allocation remaining in the accounts cannot be carried over from one water year to the next.
(4)
The following rules shall apply to the management of water allocations in the water allocation accounts of regulated river (general security) access licences in the Lower Namoi Regulated River Water source:
(a)
water allocation remaining in the accounts may be carried over from one water year to the next, and
(b)
the maximum volume that may be held in the accounts at any time shall be equal to 2 megalitres multiplied by the number of unit shares specified in the access licence share component.
(5)
Water allocation remaining in the water allocation accounts of supplementary water access licences in the Lower Namoi Regulated River Water Source cannot be carried over from one water year to the next.
