Environmental Planning and Assessment Act 1979

I, the Minister for Infrastructure and Planning, in pursuance of section 33 of the Environmental Planning and Assessment Act 1979, do, by this my Order, amend the Environmental Planning and Assessment Model Provisions 1980 by inserting at the end of clause 8 (7) the words “, or to trees situated on the Trust lands (within the meaning of the Royal Botanic Gardens and Domain Trust Act 1980)”.

Explanatory note
The object of this Order is to exclude trees that are subject to the care, control and management of the Royal Botanic Gardens and Domain Trust from being the subject of a tree preservation order made by a local government council pursuant to model provisions adopted by a local environmental plan. The Trust lands includes land known as the Royal Botanic Gardens, The Domain and the Mt Tomah Annexe to the Royal Botanic Gardens.
This Order is made under section 33 of the Environmental Planning and Assessment Act

1979.
