Application for approval of the Opus Omnia Pty Ltd Enterprise Agreement 2025

  1. Opus Omnia Pty Ltd (the Employer) has made an application, pursuant to s.185 of the Fair Work Act 2009 (the Act), for approval of a single enterprise agreement known as the Opus Omnia Pty Ltd Enterprise Agreement 2025 (the Agreement).

  1. The minimum hourly rates in clause 7.1 of the Agreement were below Award rates commencing 1 July 2025. Clause 7.3 of the Agreement further guarantees that employees will always be paid at least 10c per hour above the Award rates for the relevant classification. To ensure clarity of minimum pay rates, the Employer provided an undertaking setting out guaranteed minimum pay rates under the Agreement which gives effect to Clause 7.3. The Employer also provided a further undertaking that these pay rates will apply to the period between approval and 1 July 2025.

  1. A copy of the undertakings is attached in Annexure A. I am satisfied that the undertakings will not cause financial detriment to any employee covered by the Agreement and that the undertakings will not result in substantial changes to the Agreement. The undertakings are taken to be a term of the agreement.

  1. Subject to the undertakings referred to above, I am satisfied that each of the requirements of ss.186, 187, 188 and 190 as are relevant to this application for approval have been met.

  1. The Agreement is approved and, in accordance with s.54 of the Act, will operate from 7 July 2025. The nominal expiry date of the Agreement is 7 July 2028.
