OPTICIANS (AMENDMENT) ACT.

Act No. 16, 1931.

An Act to amend the Opticians Act, 1930, in certain respects. [Assented to. 5th May,1
1931.]
BE ii enacted by the King's Most Excellent Majesty, lative Council and Legislative Assembly of New South bv and with the advice and consent of the Legis- Wales in Parliament assembled, and by the authority of
the same, as follows :—

1 . (1) This Act may be cited as the '• Opticians;

(Amendment) Act, 193]'."

(2) The Opticians Act, 1930, as amended by this

Act, may be cited as the Opticians Act, 1930-1931.

2 . The Opticians Act, 1930, is amended—

(a) save in such cases or in such circum- stances as are prescribed practises optometry in a name other than his own; or
(b)
(a) by inserting at the end of section fifteen the i
following new subsection :— i

(5) Without limiting the meaning of the expression " infamous conduct in any profes- sional respect " in this section an optometrist shall be deemed guilty of such infamous conduct who—

(b)

allows the use of his name in connection with the practice of optometry at pre­ mises at which he is not in regular attendance for the purpose of practice and supervison; or

(c)

advertises otherwise than in a manner prescribed, or canvasses.

Every complaint respecting the conduct of an optometrist lodged with the board involving a charge of infamous conduct in a professional respect shall be accompanied by a deposit of five pounds. The deposit shall be disposed of after the hearing of the complaint in such manner as the board directs.

(b)

by inserting in section nineteen next after paragraph (d) the following new paragraph :—

(e)

has for a period of two years prior to the twenty-first day of July, one thousand nine hundred and thirty, been bona fide engaged in New South Wales in the practice of optometry, either separately or in conjunction with the practice of any other profession or call­ ing, and has passed an examination held by the board, and has made application for registration within six months from the commencement of the Opticians (Amendment) Act, 1931.

(c)

by inserting next after section twenty-six the following new section :—

26A. The board may allow the legal per­

sonal representatives of a registered opto­
metrist actually practising at the time of his death to continue such practice so long as the practice is conducted under the personal supervision of a registered optometrist.

(d)

by inserting in subsection one of section thirty next after paragraph (d) the following new paragraph:—

(dl) prescribing terms and conditions of

articles of apprenticeship to opto­

metrists. 2.

3 . The Opticians Act, 1930, is further amended by

inserting next after section thirty-four the following
new section : —

35. Nothing in this Act shall he construed to prevent a firm or company from carrying on in its firm or corporate name the business of the practice of optometry if such business is conducted by or under the personal supervision and control of a registered optometrist, and the name of such registered optometrist is prominently and legibly displayed upon the premises at which such business is carried on.
