OPTICAL DISPENSERS ACT 1963—REGULATION
(Relating to the definition of optical dispensing)

HIS Excellency the Governor, with the advice of the Executive Council, on the recommendation of the Optical Dispensers Licensing Board, and in pursuance of the Optical Dispensers Act 1963, has been pleased to make the Regulation set forth hereunder.

The Optical Dispensers Regulation 1992 is amended by inserting after
clause 3 the following clause:
Sale of certain optical appliances excluded from the definition of
“optical dispensing”
3A. The sale of hand-held magnifiers, or corrective lenses designed for use only in diving masks or swimming goggles, is taken not to be optical dispensing for the purposes of the Act.
EXPLANATORY NOTE
The object of this Regulation is to provide that the sale of certain optical appliances is not optical dispensing for the purposes of the Optical Dispensers Act 1963. The effect of this Regulation is that a person will not need to be licensed as an optical dispenser to sell the optical appliances excluded from the definition of optical dispensing under the Act.
This Regulation is made under the Optical Dispensers Act 1963, including sections 2
(2) and 35 (the general regulation-making power).
