An Act relating to the Funds of the Old Colonists' Association of Victoria.

Preamble

WHEREAS by section one of an Act passed in the forty-sixth year of the reign of Her late Majesty Queen Victoria intituled "An Act to establish and regulate a Permanent Fund in connexion with the Old Colonists' Association of Victoria"[1] as modified by the Old Colonists' Association Act 1938 there was established by law and rendered indefeasible and vested in the trustees for the time being of the Old Colonists' Association of Victoria (hereinafter called "the Association") a permanent fund consisting inter alia initially of the whole, and from the thirty-first day of October One thousand nine hundred and thirty-eight three-quarters, of all donations and bequests not otherwise specially directed by the donors thereof to be applied:

AND WHEREAS by section two of the first-mentioned Act[2] it is provided that except for the interest arising therefrom such permanent fund may not be appropriated in payment of any of the objects of the Association as set forth in the preamble to the said Act:

AND WHEREAS the interest arising from such permanent fund and such other moneys (not being part of such permanent fund) as are available for carrying out the objects of the Association are now insufficient for that purpose:

AND WHEREAS in order to make an increased amount available for the carrying out of the objects of the Association it is expedient to vary the manner in which future donations bequests and legacies shall be applied by providing that all of such future donations bequests and legacies as are not directed to be specially applied by the donors thereof together with the whole amount of donations entitling persons to be life governors and of subscriptions paid to the Association by governors may be applied towards the carrying out of the objects of the Association hereinbefore mentioned:

BE IT THEREFORE ENACTED by the King's Most Excellent Majesty by and with the advice and consent of the Legislative Council and the Legislative Assembly of Victoria in this present Parliament assembled and by the authority of the same as follows (that is to say):

1.Short title construction and citation

This Act may be cited as the Old Colonists' Association Act 1947 and shall be read and construed as one with the Act passed in the forty-sixth year of the reign of Her late Majesty Queen Victoria intituled "An Act to establish and regulate a Permanent Fund in connexion with the Old Colonists' Association of Victoria"[3] (hereinafter referred to as the Principal Act) which Act and this Act may be cited together as the Old Colonists' Association Acts.

2.Modification of application of future donations etc.

(1)Notwithstanding anything in the Principal Act or in any other Act or enactment or in any trust the following sums, namely—

(a)all donations bequests and legacies received after the commencement of this Act and not directed by the donors thereof to be specially applied;

(b)all donations made after the commencement of this Act entitling persons to be life governors; and

(c)all subscriptions paid after the commencement of this Act to the Association by governors—

may be applied to the carrying out of the objects of the Association.

(2)Nothing in this Act shall be construed as affecting the amount of the permanent fund of the Association as existing immediately before the commencement of this Act.

3.Consequential repeal of Act

The Old Colonists' Association Act 1938 is hereby repealed.
