Oilseeds Levy Collection and Research Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Oilseeds Levy Collection Act 1977.

1. Commencement

1.1 Subregulation 3.1 is taken to have commenced on 1 July 1990.

2. Amendment

2.1 The Oilseeds Levy Collection and Research Regulations are amended as set out in these Regulations.

3. Regulation 2 (Interpretation)

3.1 After the definition of "authorized agent", insert:

"'quarter' has the same meaning as in section 5 of the Act;".

3.2 Definition of "Secretary":

Omit the definition, substitute:

"'Secretary' means the Secretary to the Department;".

3.3 Definition of "the Act":

Omit the definition, substitute:

"'the Act' means the Oilseeds Levy Collection Act 1977".

4. Regulation 3 (Manner of payment of levy, &c.)

4.1 Omit "of Primary Industry".

5. Regulation 4 (Returns, &c, to be furnished by persons to whom leviable oilseeds are delivered)

5.1 Subregulation 4 (1):

Omit "immediately following the month", substitute "after the quarter".

5.2 Paragraph 4(1) (a):

Omit "month or months", substitute "quarter".

5.3 Paragraph 4(1) (b):

Omit "expiration of the month", substitute "end of the quarter".

5.4 Paragraph 4 (2) (b):

Omit "month" (wherever occurring), substitute "quarter".

5.5 Subregulation 4 (2):

Omit "immediately following the month", substitute "after the quarter".

5.6 Subregulation 4(2):

Omit "in respect of the last-mentioned month", substitute "for that quarter".

5.7 Paragraph 4 (2) (c):

Omit "month;", substitute "quarter; and".

5.8 Subregulation 4 (2): After paragraph (d), insert:

"; and (e) the quarter to which the return relates.".

5.9 Paragraph 4 (3) (b): After "his", insert "or her".

5.10 Subregulation 4(5):

Omit "month" (wherever occurring), substitute "quarter".

6. Regulation 5 (Returns, &c, to be furnished by growers)

6.1 Subregulation 5 (1):

Omit "in any month", substitute "in a quarter".

6.2 Subregulation 5(1):

Omit "immediately following that month", substitute "after that quarter".

6.3 Subregulation 5 (1):

Omit "in respect of that month", substitute "for that quarter".

6.4 Paragraph 5(l)(c):

Omit "month;", substitute "quarter; and".

6.5 Paragraph 5(1) (d):

Omit "month;", substitute "quarter; and".

6.6 Subregulation 5 (1): After paragraph (e), insert:

"; and (0 the quarter to which the return relates.".

6.7 Paragraph 5 (2) (b): After "his", insert "or her".

7. Regulation 6 (Returns, &c, to specify the month to which they relate)

7.1 Omit the regulation.

8. Regulation 7 (Authorized agent)

8.1 Subregulation 7(1): After "his", insert "or her".

9. Regulation 8 (Lodging of returns, &c.)

9.1 Omit "of Primary Industry".

10. Regulation 10 (Records to be kept)

10.1 Subregulation 10(1):

Omit "month" (wherever occurring), substitute "quarter".

10.2 Subregulation 10(2):

Omit "month" (wherever occurring), substitute "quarter".

11. Schedule

11.1 After ''"his'', insert ''or her'',
