The Parliament of Australia enacts:

1Short title

This Act may be cited as the Offshore Petroleum Amendment (Miscellaneous Measures) Act 2008.

Section 6 (definition of coastal waters)

Repeal the definition, substitute:

coastal waters, in relation to a State or the Northern Territory, means so much of the scheduled area for the State or Territory as consists of:

  1. (a)

    the territorial sea; and

  2. (b)

    any waters that are:

    (i) on the landward side of the territorial sea; and

    1. (ii)

      not within the limits of the State or Territory.

For this purpose, assume that the breadth of the territorial sea of Australia had never been determined or declared to be greater than 3 nautical miles, but had continued to be 3 nautical miles.

Section 6 (definition of territorial sea)

Repeal the definition.
