[ASSENTED TO 4TH APRIL, 1946.] B E it enacted by the King's Most Excellent Majesty, by and with the advice and consen't of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- Short title. 1. (1.) This Act may be cited as " The Officials in Parliament Acts and the Legislative Assembly Acts Amendment Act of 1946." Construction of Act. 2. (1.) This Act shall be read as one with- (i.) *" The Oonstitution Acts, 1867 to 1944 " (herein in this Act referred to as "the Constitution Acts ") ; (ii.) t" The Officials in Parliament Acts, 1896 to 1945 " ; (iii.) The t" LegislativeAssemblyAct of 1867 " (as amended by subsequent Acts); and Collective title of Officials in Parliament Acts (60 Vic. No. 3, as amended). (iv.) §" The Oonstitution Act Amendment Act of 1896" (as amended by subsequent Acts). (2.) (i.) t" The Officials in Parliament Acts, 1896 to 1945," as amended by this Act may collectively be cited as " The Officials in Parliament Acts, 1896 to 1946." Collective title of Legislative Assembly Acts (31 Vic. No. 21, as amended). (ii.) The t" LegislativeAssemblyAct of 1867" as amended by subsequent Acts and this Act may collectively be cited as " The Legislative Assembly Acts, 1867 to 1946." Collective (iii.) §" The Oonstitution Act Amendment Act of ~!~ ~~ f 1896" (as amended by subsequent Acts) and this Act may Oonstitution collectively be cited as " The Oonstitution Act Amendment ~ ~ ~ 17te~ 1" Acts, 1896 to 1946." 1896" (as amended) (60 Vic. 1946. CONSTITUTION. Officials in Parliament, Etc., Act. 4:9 3 Section five of *"The Officials in Parliament Acts, Amendment 1896 to 1945," is amended by omitting the second ~~ ~ i! l~fi~he paragraph of subsection one beginning with the words Parliament "This section shall not apply" and ending with the ~~ t~ic. words "an annual salary" and by inserting in lieu No. 3, as thereof the following paragraph, namely:- amended). "The aforesaid provisions of this subsection shall not apply to any person, otherwise qualified- (i.) Who is in receipt of a pension- (a) As an officer or member of a Naval, Military, or Air Force of the Commonwealth or of the United Kingdom or of any part of His Majesty's dominions; or (b) Being a female, on account of having served in any capacity with or with any service forming part of any such Naval, Military, or Air Forces, including service as medical practitioner, or nurse or masseuse, or otherwise; or- (ii.) Who is in receipt only of daily pay as an officer or member (male or female) of any such Naval, Military, or Air Forces and is not employed permanently or at an annual salary as such an officer or member." 4. (1.) CONSTITUTION. Officials in Parliament, Etc., Act. 10 GEO. VI. No. 14, 1946. event of such fine not being fully paid by the Member concerned immediately, or as the case may be within such period as so fixed, the following consequences shall ensue, namely:- (i.) The Speaker shall· deliver a certificate under his hand and countersigned by the Clerk of The Parliament to the Treasurer notifying the Treasurer that the said fine has not been paid (or if partly paid, setting out the amount which has not been paid) by the Member concerned either immediately or as the case may be within the period fixed by the Legislative Assembly as is hereinbefore referred to. (ii.) Thereupon the Treasurer may and is hereby authorised by virtue of such certificate (and notwithstanding that the session in which such fine was imposed has ended) to order that there be set aside, from time to time, and to be retained by the Treasurer, such sum or sums as he thinks proper out of the allowance to which such Member is entitled to be paid pursuant to *" The Constitution Act Amendment t of 1896" (as amended by subsequent Acts) until the full amount of the fine has been liquidated and paid. (iii.) The Treasurer may at any time and from time to time alter or vary any such order. (iv.) All moneys so ordered to be set aside and retained by the Treasurer as aforesaid shall revert to the Treasury and become part of the Consolidated Revenue and the Member concerned shall no longer be entitled to any payment to him thereof." Application of section. (2.) This section applies, and has and it is hereby declared always to have applied, as well to any resolution or order of the Legislative Assembly made under the Constitution Acts and/or any standing rule or order made thereunder adjudging a Member guilty of contempt and ordering him to pay a fine as referred to in subsection one of this section and made prior to the passing of this Act as to any such resolution or order made subsequent to the passing of this Act. * 60 V.
