B E it enacted by the King's Most Excellent MajestY1 by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by. the authority of the same, as follows:- Short title. 1. This Act may be cited as "The Official8 in Parliament Acts Amendment Act of 1945.". Construction of Act. 2. (1.) This Act shall be read as one with- (i.) The Constitution of Queensland, in this Act meaning and including the Order in Council of Her late Majesty Queen Victoria, dated the sixth day of June, one thousand eight hundred and fifty·nine, referred to in the Preamble to the *" Oonstitution Act of 1867," and t" The Oonstitution Acts, 1867 to 1944," and (ii.) t" The Officials in Parliament Acts, 1896 to 1944." . * 31 V. "The Officials in Parliament Acts, 1896 to 0>llective 1944," as amended by this Act, may collectively be cited ~ ~ ~ : ls in as " The Officials in Parliament Acts, 1896 to 1945." Parliament Acts. 3. Section five of *" The. Officials in Parliament ! : ns~ ~~ ent Acts, 1896 to 1944," is amended as follows : - Officials in Parliament (i.) The said section five shall be renumbered Acts. subsection one of section five. (ii.) The following new subsections two and three are added to the said section five, as follows:- "(2.) Subsection one of this section shall not apply Certain so as to prevent any person holding any office or place of pers?ns profit under the Crown who is otherwise qualified from ~ ~ ~ : ~ r being nominated as a candidate and being elected as a place of member of the Legislative Assembly; but if such f~ ~ ~ r~ ~ er person is so elected he shall vacate and be deemed may be to vacate h I · S 0 ffice or p1ace 0 f profit under t he Crown ePlaercltieadmteont. from the day appointed in the writ for taking the poll for his election. (3.) A person to whom subsection two of this section applies shall be entitled to leave of absence for a period not exceeding two months for the purpose of contesting a Legislative Assembly election: Provided that- (i.) Except as provided in paragraph (ii.)· of this subsection, he shall not be entitled to any salary during his absence from duty for that purpose; (ii.) For such purpose such person shall have and may exercise in respect of such period not exceeding two months or any part thereof any accrued right to leave of absence with salary had by him; (iii.) If such person is elected nothing in paragraph (ii.) of this subsection shall entitle or be deemed to entitle such person to leave of absence with salary during any period after the day appointed in the writ for taking the poll for his election." * 60 V.
