B E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1 This Act may be cited as "The Officials in Short title ParliamentAct Amendment Act oJ 1939," and shall be: ~ ~ struction. read as one with *" The Officials in ParliamentAct of 1896," as amended by t" The Officials in Parliament Act Amendment Act of 1920," t" The Officials in Parliament Act Amendment Act of 1922," §" The Constitution Act Amend- ment Act of 1926," 11" The Constitution Act Amendment Act of 1929," and ~ " The Constitution Act Amendment Act of 1936." 2. *" The Officials in ParliamentAct of 1896," as Further amended by the Acts hereinbefore referred to, is hereby ~ f~ ~ ~ : : ts further amended as follows, namely:- 60Vic.No.3. Section three thereof is renumbered subsection Amendment one of section three, and the following new subsections ofs. 3. two to six, both inclusive, are added to the said section three as so renumbered, namely:- . No. 29, 1939. powers, and authorities imposed or conferred upon the Officer so granted leave of absence or any other Officer mentioned in subsection one of this section by any Act, rule, practice, or ordinance, and the Member' so authorised and empowered may perform any such duties, powers, and authorities accordingly. (4.) The salary of each such Member of the Executive Council for the period during which he is, pursuant to subsection three of this section, authorised and empowered to act and so acts shall be a salary at the rate of two hundred and fifty pounds per annum in addition to the salary payable to him as a Member of the Legislative Assembly. (5.) The provisions of section five of this Act shall not apply to any Member of the Executive Council who, being for the time being a Member of the Legislative Assembly, holds, or held on or after the first day of January, one thousand nine hundred and thirty-nine, an office or place of profit under the Crown when acting or purporting to act in lieu of any Officer mentioned in subsection one of this section during the absence or purported absence on sick leave of any such Officer, and such Member is, and always has been, on and after the first day of January, one thousand nine hundred and thirty-nine, capable of being elected, and of sitting and voting, as a Member of the Legislative Assembly, and of receiving for the period during which he so acts, or has acted, a salary at the rate of two hundred and fifty pounds per annum in addition to his salary as a Member of the Legislative Assembly. (6.) This section shall not be so read and construed as to limit the provisions of section eight of this Act." Amendment ofs.5. (ii.) In section five thereof the words "and not being a Member of the Executive Council who is also a Member of the Legislative Assembly authorised and empowered by the Governor to act for the time being in lieu of any such Officer as aforesaid pursuant to subsection three of section three of this Act" are inserted after the words "Proclamation made under this Act."
