AN ACT to amend the Official Prosecutions

(Defendants' Costs) Act, 1973.

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1. (1) This Act may be cited as the Official Short title

(2) In this Act the Official Prosecutions Act No. 46

(3) The principal Act as amended by this Act may be cited as the Official Prosecutions (Defendants' Costs) Act, 1973-1974.

Section 6	3.	Section 6 of the principal Act is amended by

substituting for paragraph (a) a paragraph as

follows

(a) the Court-

(i) under section 669 of The Criminal Code, section 26, 34, or 34B of the Child Welfare Act, 1947, or section 137 of the Police Act, 1892 dismisses the charge against him; or

(ii) under subsection (la) of section 16, or subsection (3) of section 17A, of the Education Act, 1928 refrains from recording a conviction against him; .
