OFFENDERS PROBATION AND

PAROLE AMENDMENT ACT

No. 34 of 1988

AN ACT to amend the Offenders Probation and Parole Act 1963.

[Assented to 24 November 1988]

The Parliament of Western Australia enacts as follows:

Short title

1. This Act may be cited as the Offenders Probation and Parole

Amendment Act 1988.

Commencement

2. This Act shall come into operation on the day on which it receives

the Royal Assent.

Principal Act

3. In this Act the Offenders Probation and Parole Act 1963* is

referred to as the principal Act.

Section 23A amended

4. Section 23A of the principal Act is amended by inserting after

subsection (2) the following subsections

(3) The Minister may appoint a deputy for each member appointed by the Governor under section 21 (2) (e) and, at any meeting of the Board when that member is not present, the member's deputy, if any, may attend and while so attending has all the powers, functions, entitlements, and protection of the member for whom he is deputy.

(4) The Minister may, at any time, cancel an appointment made

under subsection (3). ".

Section 50V amended

5. Section 50V of the principal Act is amended

(a) in subsection (1) by deleting "other authority" and substituting

the following-

" authority ";

(b) in subsection (3) by deleting-

(i)   ", or the Chief or Principal Parole Officer"; and

(ii) "and the Board"; and

(c) in subsection (4)-

(i)  by deleting "and the Board"; and

(ii)   in paragraph (a) by deleting ", or the Chief or Principal Parole Officer".
