AN ACT to amend the Offenders Probation and

Parole Act 1963.

[Assented to 24 April 1985.]

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1. (1) This Act may be cited as the Offenders Mirgnpal

Probation and Parole Amendment Act 1985.

This Act shall be deemed to have come into

operation on 5 September 1984.

Section 34

amended.

3.

Section 34 of the principal Act is amended

(a) in paragraph (ba) of subsection (2)-

(i)  in subparagraph (ii), by inserting after "commuted," the following

other than a life sentence under section 282 (a) (ii) of The Criminal Code, ";

(ii)   by deleting the comma at the end of subparagraph (iv) and substitut- ing a semi colon; and

(iii)

after subparagraph (iv) by inserting

the following subparagraph-

" (v) undergoing a life sentence under section 282 (a) (ii) of The Criminal Code, furnish to the Minister, as soon as practicable after and not before a period of 10 years has elapsed since the prisoner was sentenced to life imprisonment and thereafter as soon as practicable after each period of 3 years, ";

and

(b) in subsection (3)-

(i) by deleting "subparagraphs (iii) and (iv)" and substituting the following-

" subparagraphs

(iv) and

(v) "; and

life imprisonment" the following

or a life sentence under section 282 (a) (ii) of The Criminal Code, as the case requires ".
