No. 40 of 1970.

AN ACT to amend section five of the Offenders

Probation and Parole Act, 1963-1969.

[Assented to 23rd September, 1970.]

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

Short title

1. (1) This Act may be cited as the Offenders Probation and Parole Act Amendment Act, 1970.	and citation.

The principal Act as amended by this Act

may be cited as the Offenders Probation and Parole

Act, 1963-1970.

S.5 amended. 2. Subsection (1) of section 5 of the principal

Act is amended by adding after the word "Act" in line five of paragraph (a), the passage, ", unless the sentence for the offence is passed by the Supreme Court or the District Court of Western Australia pursuant to subsection (3), (3a) or (3b) of section twenty of that Act".
